Study On The Legal Guarantee Of Trans-regional Environmental Collaborative Governance

Since the 18 th National Congress of the CPC,ecological civilization construction,related to people’s life and the CPC’s purpose and mission,has always been a major political and social issue.Now,the report delivered at the 20 th National Congress of the CPC points out that Chinese-type modernization is the modernization about harmonious coexistence between man and nature,which emphasized the importance of ecological civilization construction again.The problem of ecological environment has become one of the most urgent problems facing China on the journey of building a modern power.On the one hand,with the rapid and high-quality development of the social economy in recent years,coupled with the public,spillover and integral characteristics of the ecological environment itself,cross-regional environmental pollution incidents occur frequently,making it difficult for local governments to do their best in environmental governance.On the other hand,based on the increasingly convenient and developed transportation,communication and other infrastructure,highly integrated urban agglomerations with close economic ties and spatial organization are emerging,and the government service work of local governments should also gradually become systematic and integrated.Therefore,the original model of ecological and environmental governance based on administrative divisions has been unable to adapt to the integrated and coordinated development and governance needs of multiple regions.Therefore,it is urgent to break the administrative barriers between the local governments of adjacent areas,establish a good inter-governmental collaborative governance mechanism for ecological environment,and provide a good institutional guarantee for trans-regional environmental governance,so as to promote the coordinated development of regional economy and ecological environment of various urban agglomerations,realize the effective flow of resource elements,and promote the low-carbon,green and sustainable development of economy.As one of the core urban agglomerations,the Chengdu-Chongqing dual city economic circle still has a great imbalance in the dimensions of economic development and ecological governance,compared with other urban agglomerations.Therefore,based on the Shuangcheng Economic Circle in Chengdu-Chongqing area,this paper will take the current environmental laws and regulations,cooperation agreements,the latest institutional achievements such as the Outline of Construction Planning of Shuangcheng Economic Circle in Chengdu-Chongqing Area,the Eco-environmental Protection Planning of Shuangcheng Economic Circle in Chengdu-Chongqing Area and the current implementation results as the starting point.Relying on the “environmental democracy theory”,“Marxist ecological view”,“spatial justice theory” and other cutting-edge theories,through the literature analysis,empirical research and other legal research methods,to explore the lack of legal system,regulatory problems prominent,supporting safeguards are not perfect,and try to put forward the concept of “urban interests community”,We should break the shackles of regionalism in environmental governance,improve the legal and normative system of trans-regional environmental collaborative governance,implement the regulatory responsibilities and powers of all parties involved in trans-regional environmental collaborative governance,and build a supporting guarantee mechanism for trans-regional environmental collaborative governance,with a view to establishing a legal guarantee system for trans-regional environmental collaborative governance featuring“sharing protection responsibilities,regional environmental governance and ecological benefits”.
