Research On The Legal System Of Mine Ecological Restoration

Mineral resources are the food of industry and play a crucial role in China’s economic construction.However,the ecological and environmental problems caused by their development and utilization are also prominent.In order to coordinate and solve the contradiction between the development and utilization of mineral resources and ecological environment protection,the legal system for mine ecological restoration has emerged.At present,China is facing prominent mine environmental problems,but the progress of mine environmental remediation is relatively slow.With the promotion of two rounds of central environmental protection inspections,a large number of historical debts of mine ecological restoration have been exposed,and the issue of mine ecological restoration is becoming increasingly important.We must re-examine the legal system for ecological restoration in mines,think about the problems,find solutions,improve existing systems,and promote sustainable development of mineral resources.The ecological restoration of mines runs through the entire process of mineral resource development and utilization.Due to the extensive management in the early stage,a series of ecological environment problems have been left behind.To address the shortcomings in the system,this article summarizes the severe situation faced by the national ecological restoration of mines based on the current normative and practical status of ecological restoration in mines.Taking the ecological restoration practice in Yichang mines as an example,it analyzes the lack of systematic norms for ecological restoration in mines The pre prevention system is not standardized,the supervision system during the process is not smoothly connected,and the post management system is not sound;Given the professionalism,complexity,and strong policy impact of mine ecological restoration,as well as the numerous entities involved in mine ecological restoration,the responsibilities and rights assumed and enjoyed in each link are also different;Starting from the overall nature of mine ecological restoration,the author applies the principles of comprehensive governance and sustainable development theory to optimize the legal system of mine ecological restoration,in order to adjust the legal relationship between the relevant subjects of mine ecological restoration,clarify the responsibilities and rights of all parties,and build a sound legal system and industry technical standards for mine ecological restoration to serve the entire life cycle of mine ecological restoration;And proposed the establishment of a standardized system for ecological restoration in mines,improving methods and suggestions for solving current problems such as pre prevention,in-process supervision,post acceptance evaluation,and management and protection systems,striving to achieve the unity of ecological,economic,and social benefits.
