Study On Legal System Of Mine Ecological Restoration

Chinese-style modernization emphasizes the harmonious coexistence between humans and nature.With the increasing awareness of ecological civilization,there is a growing demand for a healthy and sustainable environment among the people.This has led to an urgent need to accelerate the governance of ecological damage and establish a stable long-term mechanism for environmental protection.The system of mining ecological restoration plays a crucial role in protecting the ecological environment of mines.It guarantees the effectiveness of ecological restoration,helps to form a long-term mechanism for mining ecological restoration,and enhances the relationship between mining and ecological environment protection.Furthermore,it improves the overall well-being of the people.The legal system of mining ecological restoration is a critical component of the ecological restoration system.By examining the ecological restoration practice and related systems of Helan Mountain,in this paper,the legal issues were analyzed that arise in the ecological restoration of mines.The findings indicate that these issues had a universal character and reflect common problems in China’s mining ecological restoration.For example,there was a lack of specialized legislation for mining ecological restoration at the national level,and the legal effectiveness of the relevant provisions for mining ecological restoration was low,which resulted in fragmented legal frameworks.Moreover,local mining ecological restoration systems lacked unified upper-level legal bases,and the restoration funds,standards,supervision system,and relief mechanism were incomplete.These institutional challenges indicated that mining ecological restoration was still at a low level of legalization,which hindered the effectiveness of ecological restoration in practice.To address the issues in China’s legal system for mining ecological restoration,in this paper,a set of measures were proposed.It suggested improving the legal system for mining ecological restoration and establishing a comprehensive institutional system based on the "Ecological Restoration Law," which should complement relevant departmental regulations and local laws and regulations.It also emphasized the need to clarify the basic principles of mining ecological restoration,identified the responsible parties for ecological restoration,and established a diverse funding mechanism for ecological restoration to attract social capital actively.In the paper,it was further suggested that the use of the PPP model to expand the supply of ecological restoration funds.Moreover,the regulatory system for ecological restoration must be improved,scientific and reasonable mining ecological restoration standards should be established,and the legal remedy mechanism for ecological restoration public interest litigation should be unblocked.By systematically improving the mining ecological restoration system,mining ecological restoration can be legalized,and the sustainable development of mineral resources can be ensured.This would also help protect the ecological environment of famous mountains such as Helan Mountain and make mining ecological restoration a model for achieving harmonious coexistence between humans and nature.
