| Basin is a natural geographical area formed by water as the core element and link.The basin ecosystem is a complex humanistic ecosystem,which is of great significance to human beings.Under the arbitrary destruction of human ecological resources in the river basin and the influence of global climate change,the problems of ecological degradation,soil erosion and the sharp decline of biodiversity are prominent,and the structure and function of the river basin ecosystem have been seriously damaged.Under the background of ecological civilization construction in China,basin ecological restoration has become an important choice to restore the dynamic balance state of basin ecosystem.At present,China has no special and unified legal provisions on watershed ecological restoration.At the legal level,the "four wading laws" can be universally applicable laws for all river basins.The Yangtze River Protection Law,as the first national legislation in China,has achieved a major breakthrough in the special legislation of river basin.At the level of administrative regulations,The State Council has issued the Regulations on the Management of the Taihu Lake Basin and the Interim Regulations on the Prevention and Control of Water Pollution in the Huaihe River Basin for the protection and restoration of specific river basins.In addition,there are many legislation at the level of local regulations,which are specific watershed legislation,and all are local legislation,which is decentralized.The improvement of the legal system of basin ecological restoration will certainly promote the more extensive and effective development of basin ecological restoration in China.This paper focuses on the integrity of the ecological restoration of the basin,first defines the legal connotation of the ecological basin restoration,emphasizes that it is the restoration of the structure and function of the basin ecosystem,and expounds its nature and theoretical basis.Through the development of river basin ecological restoration legal system context summary analysis and classification research,deeply understand the legal architecture and system of river basin ecological restoration in China,combined with the practice of river basin ecological restoration related matters,found that the current river basin ecological restoration legal system has "fragmentation" characteristics,repair subject,means,funds of legal system is insufficient,the government coordination repair system has not been implemented.Drawing on the advantages of ecological restoration in river basins outside the region and based on the actual situation of river basin ecosystem in China,the paper puts forward the institutional conception of improving the legal system of ecological restoration in China,expanding the main scope of ecological restoration in the river basin,building a diversified capital investment system,and innovating the coordination mechanism and system. |
