| In the development of the world economy,whether it is energy consumption or industrial development,mineral resources play an important supporting role.In the development and utilization of mineral resources,sewage discharge,carbon emissions exceeding standards,and waste residue disposal occur from time to time,which not only has a serious impact on the living environment,but also threatens the ecological environment on which human beings depend,and the environmental problems caused by the development and utilization of mineral resources cannot be ignored.With the rapid development of my country’s socialist economic construction,the construction of ecological civilization has also become an important construction site.From the 17 th National Congress of the Communist Party of China to the20 th National Congress of the Communist Party of China on October 16,2022,my country has attached great importance to the construction of ecological civilization.Construction is well under way.In response to ecological problems in mining areas,my country has carried out relevant ecological restoration work.However,the legal provisions on the responsibility for ecological restoration still cannot provide legal support for the problems existing in practice,resulting in obstacles to the restoration of the ecological environment.Solving the problem of ecological environment restoration in mining areas has become one of the problems that must be solved on the road to promote high-quality economic development,achieve carbon peaking,carbon neutrality,and build a socialist modern and powerful country.Therefore,it is of great significance to improve the legal system of ecological environment restoration in mining areas to guide the practice of ecological work and justice in mining areas in my country.This article analyzes the legal system problems existing in the process of ecological environment restoration in mining areas under the concept of green development from the perspective of law,and puts forward feasible measures and suggestions.First of all,starting from the theoretical content,the concept of ecological environment restoration is discussed in detail,and the theory related to the ecological environment restoration of mining areas is expounded,so as to provide strong theoretical support for the improvement of the legal system of ecological environment restoration in mining areas.Secondly,according to the current practice status of ecological environment restoration in mining areas in China and the current legislative status of ecological environment restoration in mining areas in China,the main problems existing in the existing legal system of ecological environment restoration in mining areas are sorted out,and in view of the legal problems such as the uncertainty of the subject of legal responsibility,the lack of special provisions for the determination of ecological damage assessment standards in mining areas,the lack of continuity of supervision in the field of ecological restoration,and the pressure on restoration funds,combined with the construction achievements of the legal system of ecological restoration in mining areas outside the region,this paper analyzes and draws on the construction results of the legal system of ecological restoration in mining areas outside the region.Finally,in order to improve the legal system of ecological environment restoration in my country’s mining areas,it is proposed to clarify the subject of legal responsibility and restoration,improve the continuity of supervision,and form a comprehensive supervision of the whole society that is "mainly government supervision,supplemented by social supervision,and supplemented by enterprise self-supervision".Targeted and innovative suggestions such as providing a basis for ecological restoration work,standardizing ecological damage assessment standards in mining areas,broadening funding channels,activating social funds to enter the field of ecological restoration,establishing a list of enterprise ecological dishonesty,and forcing enterprises to pay attention to ecological protection,in order to provide action guidelines for guiding the restoration of the ecological environment in mining areas. |
