Research On The Status Quo And Countermeasures Of The Implementation Of The Yangtze River Protection Law Promoted By The Green Principle

At present,the domestic watershed ecosystem is fragile,and the environmental capacity is very limited.The phenomenon of resource depletion is increasingly prominent.The risks of ecological environment and human health are increasing.The special geographical environment and natural resource conditions have exacerbated the imperfect and unbalanced development of China’s economy and society.At present,the protection of the ecological environment of the Yangtze River is highly valued.From the perspective of the green principles of the Civil Code,"green development",as a special chapter of the Yangtze River Protection Law,is the core content of implementing the Yangtze River Protection Law.It is of great significance for promoting the development of resource protection in the Yangtze River basin and the construction of the beautiful Yangtze River,and is also a direct manifestation of the penetration of green principles into the Yangtze River Protection Law,It has very practical significance in promoting the ecological environment protection of the Yangtze River.This article applies methods such as literature review,case analysis,and on-site investigation,based on an empirical study of the Sichuan section of the Yangtze River Basin,to study the implementation of the Yangtze River Protection Law from the perspective of green principles.Therefore,the analysis of the legal status,implementation effectiveness,and judicial effectiveness of the Sichuan section of the Yangtze River Protection Law in this article is of great value.At the level of sorting out the legal status quo,the first step is to sort out the relevant laws and regulations in the upper reaches of the Yangtze River,and compare and analyze the protection regulations of Jialing River,Tuojiang River and Leshan City in the upper reaches of the Yangtze River;The second step is to analyze and compare the river and lake chief system regulations in the upper reaches of the Yangtze River in Qinghai,Chongqing,and Sichuan regions in a table format,based on the latest implemented river and lake regulations in Sichuan,in order to examine the implementation of the Yangtze River Protection Law.At the level of implementation effectiveness in typical areas of Sichuan Province,this article analyzes the specific effects of the implementation of the Yangtze River Protection Law in various regions based on on-site investigations in Luzhou,Yibin,and Ganzi.In terms of judicial practice,this article focuses on the current situation of judicial implementation in the Sichuan section of the Yangtze River Protection Law,focusing on the "Four Circles and Four Tongs" in Aba Prefecture,the "Carbon Sink" model in the Ya’an new watershed,and the application of the highly distinctive "Button Court" in the Tuojiang River,clarifying the guidance of green principles in judicial practice.Based on the implementation of the Yangtze River Protection Law in Sichuan Province,this paper analyzes the changes in the number of seven major cases of environmental pollution crimes on the Sichuan Ecological Information Disclosure Website from 2021 to 2022,and the Judgment Document Network.From the perspective of green principles,this paper analyzes the problems of green supervision,green development concept,and green publicity in the implementation of the Yangtze River Protection Law.Finally,based on the above analysis,this article proposes a sound mechanism for the implementation of the Yangtze River Protection Law from the perspective of green principles in the research,creating sufficient conditions for the promotion of the experience in Sichuan section.
