| In 2010,the State Council issued the "National Main Functional Area Plan",which first proposed the concept of ecological products,and since then,China has held many meetings and issued a series of policy documents,and put the task of realizing the value of ecological products on the agenda in 2016;In April 2021,after experiencing two batches of local pilot practices,the General Office of the CPC Central Committee and the General Office of the State Council issued the Opinions on Establishing and Improving the Value Realization Mechanism of Ecological Products,absorbing the pilot experience of ecological product value realization in various regions,and initially establishing an institutional system for realizing the value of ecological products at the central level.However,on the whole,the current legal system for realizing the value of ecological products is still in the exploratory stage,there are few legal provisions directly related to ecological products,the relevant legal system for the realization of the value of ecological products is not perfect,and it is urgent to establish a set of systematic,standardized and orderly legal system for realizing the value of ecological products.Based on the concept of ecological products and the connotation and nature of ecological product value realization,this thesis summarizes four modes of ecological product value realization based on three batches of typical cases released by the Ministry of Natural Resources,namely ecological compensation model,ecological product trading model,ecological industrialization model and ecological restoration model.Through comparative analysis,empirical analysis and other analysis methods,based on the current national laws and regulations,the four legal systems around the four value realization models are explored from the perspective of the realization of the value of ecological products,and the problems existing in the four legal systems in the realization of the value of ecological products are pointed out,including unclear ecological compensation standards,difficulty in confirming and trading ecological products,unclear legal relationship of ecological industrialization,and lack of specific government responsibilities for ecological restoration.and put forward suggestions and thoughts on clarifying the legal relationships between ecological compensation,ecological product trading,ecological industrialization and ecological restoration in the realization of the value of ecological products,using the results of ecological product value accounting as the basis to determine compensation standards by category,clarifying government responsibilities,and stimulating the participation of social capital in ecological restoration,so as to provide a sound legal system guarantee system for the realization of ecological product value. |
