There are many kinds of nature reserves in our country,which cover a vast area.For a long time,the strategy of“Rescue Protection” has been basically carried out,the construction and management of nature reserves can not keep up with the pace of accelerating the construction of ecological civilization in our country in the new era.The relevant guidelines clearly put forward the establishment of national parks as the main body of the nature reserve system.The fund operation is the blood that maintains the daily operation of the nature reserve,and plays a vital role in the construction of the nature reserve system in our country,establishing and perfecting the legal system of fund guarantee is the need of implementing the construction project of Nature Reserve System,and also the need of accomplishing the important reform task of establishing the Nature Reserve System with national park as the main body in our country.By analyzing the connotation and legal basis of the legal system of the fund guarantee of the nature reserves,this thesis puts forward the problems existing in the current legal system of the fund guarantee of the nature reserves in our country,and with our country this system carries on the comparison,proposed consummates this system the suggestion.It is divided into the following five parts:The first part is the introduction,mainly introduced the research background of the nature reserve fund guarantee system,explained the research significance of perfecting the nature reserve fund guarantee system,by analyzing and summarizing the domestic and foreign scholars’ research on the legal system of the fund guarantee of nature reserves,we can grasp the system as a whole.The second part is an overview of the legal system of financial security of nature reserves.This thesis expounds the basic connotation of the legal system of financial security of nature reserves,explains the necessity and feasibility of this legal system,and probes into the logical premise of the legal system of financial security of nature reserves based on the legislative principles.The third part is the practice of our country’s natural reserve fund guarantee legal system.By analyzing the current legislative situation and existing problems of the legal system of fund guarantee in various types of nature reserves,the author points out that the relevant legislation is not sufficient,the fund supervision system is not complete,the legal system is not perfect and so on.The fourth part introduces the capital guarantee legal system in the construction of nature reserves.To the American,Japanese and German legal system from the legislative basic situation,the fund supervision system,the fund legal system three angles cut in,seeks the place which is worth our country absorbing and drawing lessons from,carding out our country natural reserve fund guarantee legal system related problems of the solution path.The fifth part puts forward our country natural reserve fund guarantee legal system construction suggestion.Combined with the special situation of nature reserves in our country,this thesis discusses the basic ideas of solving the existing problems in our country from three angles of legislation,supervision system and legal system,to put forward concrete suggestions on strengthening the legislation of the fund guarantee system of the nature reserves,perfecting the fund supervision system and perfecting the legal system of the fund guarantee system,for our natural reserves to contribute to the rule of law work.
