As an important strategic resource, oil is playing a important role not only in economic security of a country, but also in military and political security. Therefore, oil Stocks has become a important means which can regulate supply and demand in market, maintain security of national political, economic, and military. and now, it is an important factors which is affecting supply and demand in the world oil market.Today, China has joined WTO, the fierce competition and price fluctuations in the international oil market, will directly affect to domestic market changes.Oil reserves will undoubtedly become an important means to the national macro-management of the oil flow and intervening in the market.To stabilize the domestic oil market supply and demand, avoid the economic ups and downs, it is need to establish the legal system of oil reserves.Since the 70s of the 20th century, the United States, Japan, Germany, as represent of many Western countries gradually established a relatively complete legal system of oil reserves, which have played an important role in the maintenance of national energy and economic security.Current, there are still many gaps in our legal system of the oil reserves, the legal system construction of oil reserves has just started and needs further study to accelerate legislation to meet the national need for new area of energy development strategies.The first part describes the legal system of oil reserves, after get a clear concept of the oil reserves and it's main mode, the author deepen the connotation of the legal system of oil reserves, and illustrates why we should build the legal system of oil reserves. The second part expounds the theory basis of legal system of oil reserves from three aspects: sustainable development theory, geopolitical theory, resource safety theory. The third part is the comparative analysis about legal system of oil reserves in America, Japan and Germany. The author firstly introduces the main point about legal system of oil reserves in those three countries, then compare them to build China's oil reserve legal system. The fourth part analyzes our oil reserve legal system status from the Constitution, Law, local laws and administrative regulations levels, and evaluates our existing legal system of the oil reserves. The fifth part put forward the author's proposals about how to build our country's oil reserve legal system. The author believes that firstly we should establish the basic principles of oil reserves legal system, and then build our country's oil reserve legal system from five aspects such as subject, mode selection, management department, financial system, responsibility, at the same time improve the coordination between oil reserve legal system and the relevant supporting legislation.
