Research On Problems And Countermeasures Of Administrative Law Enforcement Of Road Transport In Dalian

The road transport sector plays a vital role in Dalian's economic,political,cultural and social development.At present,China's road transport industry has developed rapidly,the industry in order also has a more standardized way.But as the concept of governing the country according to law continues to strengthen,and the rapid development of the road transport industry,in fact,the imbalance between the administrative law enforcement of road transportation and the high-speed development of the modern road transportation industry is also gradually highlighted.Therefore,to further study the problems and difficulties in the administrative law enforcement of road transport in Dalian and put forward corresponding countermeasures and suggestions,so as to give full play to the new advantages of the administrative law enforcement of road transport under the new normal,it is very urgent and important that the administrative law enforcement of road transportation can better serve the local economy and society and ensure the rapid development of road transportation.In this paper,the new public management theory and the theory of government by law as the theoretical guidance,the use of Literature Research,in-depth interview research methods,and other research methods,are discussed in six chapters.The first chapter is introduction,which introduces the research background,research significance,research ideas and research methods,and summarizes the research literature at home and abroad The second chapter is the related concept and the Theory Foundation,has defined the road transportation administrative law enforcement the main concept,elaborated this article application related theory,the third chapter is the Dalian Road Transportation Administrative Law enforcement present situation analysis,through the bar chart,pie chart and other forms,more intuitive analysis of the study object,the Fourth Chapter is the Dalian Road Transport Administrative Law enforcement problems and the reasons for analysis;The fifth chapter is to sum up the experience worth learning and using for reference at home and abroad,and to put forward the corresponding countermeasures to the problems of Dalian Road Transportation Administrative Law Enforcement;Chapter 6 conclusion.This paper studies and analyzes the current situation,problems and causes of the administrative law enforcement of road transportation in Dalian from several dimensions.First,the institutional mechanism is not reasonable,and the decentralized law enforcement model leads to the phenomenon of multiple law enforcement powers and responsibilities being unclear from time to time.Second,the law enforcement subjects are not balanced,the law enforcement force is insufficient,the professional quality and level of law enforcement personnel are relatively low,and the law enforcement concept lags behind,lack of professional law enforcement training;third,the quality of the jurisdiction object needs to be improved,the quality of the relevant practitioners is uneven,the legal consciousness is weak,the process of law enforcement investigation and evidence collection is difficult,the difficulty of administrative punishment increases.Fourth,the level of law enforcement information technology is low,the construction of information networking is backward,there is a lack of workers in the same system,paper documents have been forged,and the investment in law enforcement technology and equipment is insufficient;fifth,the system is not sound,lack of high-level binding strong laws and regulations,as well as some industry supervision supporting laws and regulations;sixth,lack of effective internal and external supervision.In the light of the main existing problems,this paper puts forward six specific countermeasures.First,in terms of institutional mechanisms,it is proposed to set up a comprehensive law enforcement agency to innovate the law enforcement model;second,at the level of law enforcement subjects,it is necessary to enrich the strength of law enforcement forces,increase the professional quality training of law enforcement personnel,and establish correct law enforcement concepts;and third,at the level of jurisdiction objects,we will step up publicity of laws and regulations in the industry,strictly control the entry of professional qualifications into the customs,build a credit system for practitioners,and strive to improve the quality and law-abiding awareness of practitioners;fourth,in the area of law enforcement information technology,we will establish our own information system for road transport administrative law enforcement,establish a mechanism for sharing information,establish a nationwide network for document management and search,and strive to upgrade the level of law enforcement equipment.Fifth,at the level of law enforcement systems,we will strengthen industrial legislation,sixth,strengthen the level of law enforcement supervision,strengthen the internal and external supervision and control mechanism.
