The Realistic Dilemma And Optimal Strategies Of Social Organizations Participating In Minor Community Correction

In recent years,some real cases about minor delinquency have aroused widespread discussion on the protection of minor rights and the punishment of minor delinquency,how to prevent and punish minor crimes while also protecting the legal rights and interests of minors has become a major problem.Community correction is a way of execution that combines punishment and protection education,and it is also more suitable for criminal minors.Community corrections are carried out based on the environment and resources of the community,but the current level of community development in our country is uneven.The staffing of community organizations or institutions cannot match the professional requirements of community corrections,and it is often administrative.These practical conditions all show that it is not enough to rely on the power of the community to carry out.Community corrections also need more social forces to intervene.Among them,social organizations,as providers and managers of professional correction method systems and professionals,participate in community corrections through government purchases of services.This is also consistent with the value orientation and public welfare attributes of social organizations that care about special groups,provide public services,and enhance social welfare.Therefore,this article takes the community correction of criminal minors as an entry point,analyzes the status quo of social organizations participating in minor community corrections,and further explores the realistic dilemma of social organizations participating in minor community corrections and how to achieve a breakthrough.The research has found that there are four pairs of contradictions in the participation of social organizations in minor community corrections:the contradiction between resource dependence and independent development,the contradiction between embedded interaction and social exclusion,the contradiction between supervision and education correction,the contradictory relationship between exclusive competence and personnel mobility.Among the four pairs of difficult relationships,there are not only the "stubborn illness" of social organizations,but also new challenges in the special situation of minor community corrections.The causes are:the asymmetry of the cooperation between social organizations and the government,the non-symbiosis in collaboration between social organizations and the government,the imbalance between social organization’s"management" and "teaching" of minor correctional subjects,social organization’s ability and staff instability.The corresponding optimization strategies are:reaching a mutually beneficial cooperative relationship with the government,building a harmonious and symbiotic relationship with the community,paying attention to the standardization and individualization of minors’ community correction work,and realizing the sustainable development of social organizations.
