In recent years,the phenomenon of troublemaking psychiatric persons committing crimes and accidents frequently appears,which seriously affect the public’s sense of social security and has become an important problem in public security governance.In the present background of promoting the modernization of community governance capacity,it is an important research topic to build a complete community governance system,improve the ability of security control for troublemaking psychiatric persons who have committed crimes and accidents,and enhance the public’s sense of security.By introducing community governance theory and collaborative governance theory,based on community-level security prevention and control,this research reviews the development history of community security control for troublemaking psychiatric persons in China and analyzes the current problems of security control for troublemaking psychiatric persons and the causes through field research,unstructured interviews and case studies.By examining the experience of community governance of troublemaking psychiatric persons in developed countries,this research propose countermeasures for the community security control of troublemaking psychiatric persons in China.According to the social development and difference of control direction in different periods,the community security control of troublemaking psychiatric persons in China can be divided into three historical stages: the conception stage at the founding of the country,the local exploration stage after the reform and opening up,and the improvement stage driven by the legislation of the Mental Health Law.The research found that China’s community security control of troublemaking psychiatric persons is plagued by lagging construction of community security control teams,poor guardianship and management of troublemaking psychiatric persons,difficulty in applying compulsory medical treatment and sending them to treatment,and failure of mechanisms under critical conditions such as COVID-19 prevention.The reasons for the current dilemma involve: first,the supply of community security control systems for troublemaking psychiatric persons is seriously inadequate;second,the coordination mechanism between the various management and control bodies of troublemaking psychiatric persons remains poor;third,the finance of community security control for troublemaking psychiatric persons is inadequate;fourth,the difficulty of community integration of troublemaking psychiatric persons leads to an increased risk of causing accidents and committing crime;fifth,the implementation of management and control measures such as information registration,regular home visits,and door-to-door inspections is not effective.The research concludes that China should rely on the community for the security control of troublemaking psychiatric persons and make systematic changes in five aspects: First,in governance model,we should shift from top-down administrative control to community mental health systematic governance,ensure the leading role of the government,strengthen the coordination and cooperation of various bodies in the community mental health governance system,rely on the community field,supplement social capital,and establish a regular systemic management and control model.Second,in mechanism construction,we should shift from the traditional prevention-oriented control to active services,build a mechanism to transform in normal and non-normal conditions,and make the smooth transformation of normal and nonnormal governance by establishing a multi-level community mental health service network and building a self-organized systemic governance structure.Third,in control measures,we will shift from explicit control to soft implicit control,and take into account the right to information of community members and the rights and privacy of troublemaking psychiatric persons through the care and support system.Fourth,in community support,education should be provided to enable the public to accept and promote the integration of troublemaking psychiatric persons into the community,and to reduce the risk of mental illness in the early stage.Fifth,in technical support,technology should be used to empower the community to move from traditional human-based prevention and control to community-oriented intelligent manage and control. |
