Research On The Problem Of Rude Law Enforcement In Urban Management Based On The Theory Of Street Bureaucracy

In the context of the accelerating urbanization process and the continuous improvement of urban management in China,urban management law enforcement,as our unique local comprehensive administrative law enforcement agency,has gradually become one of the must-haves in cities across the country despite its history of less than 20 years,and made great efforts and contributions to urban development.At the same time,however,due to the lack of specific national laws and regulations,the urban management institutions in different places are not the same and each does things in its own way.The contradictions in law enforcement caused by non-standardized law enforcement emerge endlessly.With the development of the information society,in recent years,the “urban violent law enforcement ” incidents that have been continuously exposed in various places have gradually become a vicious label of the entire urban management department due to the government ’ s lack of response and the repeated speculation of public opinions.This paper begins with the study of the universal law enforcement model ofurban management law enforcement.Based on the Western classic street bureaucratic theory,combined with questionnaire surveys,and through correlation analysis and situational case studies,this paper interprets and analyzes the behavioral logic of frontline law enforcement personnel working on the streets in urban management law enforcement.It is found that the issue of violence in urban management law enforcement is not simply an accidental event caused by individual factors.It is an inherent problem in its law enforcement system.It is largely the result of generalized rude means of law enforcement.The rudeness here refers more to the rudeness and simplicity in law enforcement thinking and form.It is a simple abuse of administrative enforcement measures by law enforcement personnel for the purpose of achieving law enforcement effects,and is not equivalent to violence itself.This kind of rudeness is a passive choice for front-line law enforcement personnel in the face of strong pressures for law enforcement.The root cause lies in the fact that under the current domestic administrative system,urban management law enforcement lacks the necessary authority to perform its own duties,and its discretionary power is only acted on the law enforcement process.They are incapable of dealing with the execution of punishments and getting into the difficulty of enforcement.In the process of reference and analysis of the theory of street bureaucracy,it is found that the limitations of this theory interpreting specific street bureaucracy in China.Therefore,this paper then innovatively introduces theperspective of powers and responsibilities,and enriches the spatial basis of the theory and the target range.Starting from the principle of reciprocity of power and responsibility,it proposes a solution to relieving the problem of urban management rudeness,with the view to promoting the law enforcement of urban management to be legal,standardized,and civilized.
