A Study On The Legal System Of National Parks In China

The concept of human development has undergone a transformation from conquering nature to fearing nature.in the 21 st century,people pay more attention to the protection of the ecological environment.the establishment of protected areas is to better protect the natural environment on which people depend for their survival.The national park system is a more mature development model of protected areas,which has opened a new world for the protection and utilization of natural resources in the world,and has been widely recognized by all countries in the world.National parks play an important role in the management of land and resources.they have achieved a balanced development between resource development and ecological protection.national parks have been established from the beginning to the maturity of various systems and systems.It has played its functions in environmental protection,economic construction and culture.China has always attached importance to the protection of the ecological environment and adhered to the sustainable development of economy and society.From the point of view of sustainable development and based on the global development trend,the third Plenary session of the 18 th Central Committee of the Communist Party of China(CPC)put forward the establishment of a national park system in China.This has completed the top-level design for the construction of national parks,indicating that promoting the construction of national parks has become an important measure for the construction of ecological civilization in our country.However,in the current legal system of China,in the legislative system and specific practice,there is still the problem of inadequate protection of national parks.The main reasons for this phenomenon are the lack of national park law,the disharmony of legislative purpose,the lack of relevant standards of national parks and other factors.Firstly,this paper combs the present situation of the development of the legal system of nature reserves in China,and expounds the present situation and existing problems of the legal protection of national parks in China.Secondly,on the basis of the research on the advanced experience of the construction of the legal system of national parks in foreign countries and Taiwan,this paper summarizes the advanced experiences and methods worthy of our country's absorption and reference.Finally,starting from the necessity and feasibility of perfecting the legal system of national parks in China,this paper puts forward some countermeasures and suggestions for the construction of the legal system parks in China.Through the application of literature research method,comparative analysis method,normative research method and interdisciplinary research method,the conclusion of the study is that the perfection and development of China's national park legal system should focus on the renewal of the management system and the follow-up of park legislation.And the perfection of the specific park legal system and management system;In the aspect of management system,China should establish the classification and refinement of the national park management system.At the same time,on the basis of formulating the national park law,perfect the national park legislation,optimize the law enforcement mechanism,increase the crackdown on the destruction of the natural resources and environment,so as to ensure that the relevant laws of the national park can be truly complied with;At the same time,in the construction of the specific legal mechanism of the national park,we should focus on improving the franchise mechanism,ecological compensation mechanism and public participation mechanism.
