In order to realize the effective protection of China's natural ecological system,adjust the existing system of natural protection sites,and solve the existing problems of separation and fragmentation of management,The party central committee and the state council have put forward plans for the establishment of "national parks",and have started the pilot construction.The pilot areas adopted the legislative model of "one district one law" to regulate the management system,resource protection and utilization,community interest protection and relevant legal responsibilities of national parks.However,due to the lack of national unified legislation,the legislative authority of pilot areas is on the low side,part of the legislative norms conflict with the host law obviously.At the same time,the phenomenon of local functional departments competing for legislative interests also reveals the limitations of pilot district legislation.Through the comparison of the pilot area management system,ecological compensation,franchise and community development and other legislative norms,it is found that the pilot legislation also has the problem of "too much policy response,insufficient implementation and implementation".Based on the above legislative issues,this paper studies the legislative experience of "national parks" in foreign countries.And suggest that,The macro level,the natural protected area(or national park)legislation system should include two aspects of national park administrative regulations and the basic law of ecological protection,moreover,the corresponding countermeasures and Suggestions are put forward for the legislative norms of management system,ecological compensation,franchising and community benefit protection.And complete the writing of this paper...
