A Study On The Legislation Of Protected Area In China

Protected area is a space carrier for protecting ecological security,maintaining biodiversity,and preserving natural relics.It has an irreplaceable effect on the survival and development of the country and even human beings.The rich species resources in protected area are the common wealth of mankind.However,with the development of our country’s economy,people’s demands for economic benefits in protected area have continued to deepen,in addition,in reality,there are many government organizations,such as multi-management,overlapping,protection and development,which make the nature reserves face serious ecological crisis.From the new time,protected area have put forward systemic construction requirements.Therefore,this article has carried on the systematic research from the protected area legislation angle,has analyzed in the nature reserve legislation the question,and proposed some opinions and the suggestion:The text encompass five chapters:The first chapter introduces the research purpose and significance and literature review,Secondly,the chapter makes a theoretical analysis and definition of the legal concept of natural protected areas,and studies and delimits the scope of protected areas.It analyzes the current situation of national legislation and local legislation of natural protected areas from the perspective of legislation and finally evaluates and summarizes them.The third chapter mainly studies the main problems facing my country’s current protected area,including the low level of legislation,lack of comprehensiveness,unclear principles and concepts of protected area legislation,lack of scientific legislation in the legislative system,lack of subordinate legislation and local legislation Coordination and so on.The fourth chapter is based on combing and studying the legislation practice of nature reserves in the United States,Russia,New Zealand,and Japan.It is concluded that the legislation for my country’s nature reserves should be based on the national conditions to select the legislative model,implement the ecological priority legislation concept and strengthen the internal environmental administration.Enlightenment from the diversified forms of coordination,cooperation and public participation.we suggestions that formulating high-level comprehensive protected area laws;New law should clarify the legal principles of protected area and implement the priority principle of ecological protection,establishing a scientific and integrated nature reserves classification system,establishing the mechanism of prior consultation and supervision by Government Departments and so on.
