In December 2018,the State Council issued the "Notice on Printing and Distributing the Pilot Work Plan for the Construction of "Waste-Free Cities".The "11+5" cities such as Shenzhen,Baotou,and Weihai began to pilot the construction of "Waste-free Cities"."Waste-free city" as an advanced urban development and management concept does not mean the complete removal of urban waste,nor the complete resource utilization of urban solid waste,but the overall planning of economic and social development and urban solid waste management.Under the guidance of the concept,explore an urban development model that reduces its environmental impact by promoting the formation of green consumption,low-carbon development,and recycling development,and recycling the solid waste that has been generated.As the largest developing country in the world,my country produces a large amount of municipal solid waste every year.If the legal system can be established to promote the reasonable disposal of these solid wastes,it will not only alleviate the pressure on the urban environment,but also re-use part of the municipal waste.Re-play its efficacy and reduce the consumption of ecological resources.At the same time,urban residents can also form a green and healthy lifestyle and promote the harmonious coexistence of the city and nature.However,the disposal of municipal solid waste is a systematic project,which cannot be realized by a single subject,and requires multi-party cooperation and multi-party governance.However,for a long time,urban solid waste management has mainly relied on the promotion of administrative agencies.The main responsibility of the enterprise has not been exerted.The participation of the enterprise is not strong,and the social investment and force intervention are not enough,although the "Solid Waste Pollution Prevention and Control Law" and other laws and regulations have provisions on this Although,most of them are advocacy policies,not strong in operability,and they are difficult to implement in practice and become guiding documents.The main responsibilities of the various departments of the administrative agency are not clear,the degree of collaboration is not high,and the supervision is lacking.As a result,the efficiency of solid waste disposal has not been high,and the concept of coordinating urban development and solid waste management has not formed effective guidelines and constraints on urban development.Therefore,it is necessary to transform the past government-led governance model,clarify the role of the government in environmental governance,build a new urban solid waste management model led by the government,corporate entities,and extensive participation from all walks of life,and explore stable and mature management experience and systems in a timely manner The results are fixed through legislation,and the innovation of the solid waste management model is continuously promoted with the rule of law thinking and methods.The main content of this article is composed of the following five parts:The first part focuses on a brief overview of the legal system for the utilization of urban solid waste resources from the perspective of "waste-free cities",and clarifies the specific meaning of urban solid waste and "waste-free cities" by analyzing the theoretical research results of relevant policy documents of "waste-free cities" And the characteristics of the development model of "No-Waste City";Then,it analyzes the development status and existing problems of the utilization of municipal solid waste resources,leading to the necessity of guiding the utilization of municipal solid waste resources with the concept of "No-waste city";finally,analyze the city The theoretical basis of the legal system for solid waste resource utilization.The second part mainly introduces the development status and existing problems of our country's municipal solid waste recycling legal system.First,we must clarify our country's municipal solid waste recycling policy and legal goals,and then analyze the relevant policies of our country's municipal solid waste recycling utilization.Progress and legislative progress,through the combing of policies and laws,led to the practical dilemma of the implementation of the legal system of urban solid waste recycling in my country.The third part is the experience in the construction of foreign "waste-free cities" and the legal system for the utilization of urban solid waste.Through the analysis of the legal systems for the utilization of urban solid waste in the three developed countries of Germany,Japan,and the United States,it summarizes the cities in developed countries abroad.The legal system of solid waste recycling can be used for reference to our country.The fourth part is the relevant suggestions for the improvement of the legal system for the utilization of urban solid waste in my country.In response to the legal issues that have arisen,this chapter proposes corresponding measures and suggestions from the aspects of legislation,responsibility subjects,supervision,and marketization mechanisms.
