Research On Legislation Of Resource Utilization Of Electronic Waste In China

Nowadays,with the continuous progress of science and technology,the rapid development of electronic information industry,a variety of new electronic and electrical equipment emerge in endlessly.At the same time,the original electronic and electrical equipment has been eliminated due to reaching the service life cycle of the product,the natural renewal of the product,and the defective products produced in the production process due to technology or production negligence,which have produced countless electronic wastes,and brought a large number of environmental pollution problems.Therefore,the recycling of electronic waste has become a common concern of the society,and gradually into the orbit of legalization.In terms of legislation,China has successively promulgated a series of environmental laws and regulations,such as the law on environmental protection of solid waste pollution and the law on promoting circular economy,to provide protection for the recycling of electronic waste from the legal level.But up to now,the legislation of e-waste in our country is not very perfect,which can not break through the difficulties in legislation,resulting in the actual resource-based work can not be effectively carried out.Therefore,this paper focuses on the legislation of e-waste recycling,which is divided into four parts:The first part is the theoretical basis of e-waste recycling in China.Starting from the definition of the concept of e-waste,this paper introduces its characteristics and hazards,summarizes the significance of e-waste recycling,and points out the theoretical basis of e-waste recycling,which provides a theoretical basis for the improvement of legislation in the future.The second part is the analysis of legislation status of e-waste recycling in China.According to the effectiveness level of the law,this paper analyzes the relevant legal provisions of e-waste one by one,and points out that there are some problems in the legislation of e-waste recycling in China,such as the imperfect legal system,the disunity of legal concepts,the imperfect provisions of the circular economy promotion law,and the defects of special legislation.The third part is the Enlightenment of foreign legislation on e-waste recycling to China.Through combing the legislation of e-waste in the EU,the United States,Japan and other countries,on the basis of in-depth understanding and analysis,this paper summarizes some useful experience,as the Enlightenment of improving the legislation of e-waste recycling in China.The fourth part is the improvement of legislation of e-waste recycling in China.Based on the analysis and measurement of the interests of all parties to be considered in the process of improving the legislation of e-waste recycling,this paper puts forward suggestions for improving the legislation of e-waste recycling in China from the aspects of improving the legal system of e-waste recycling,making comprehensive legislation,and improving the law of promoting circular economy.
