Abstract/Summary:
Since the reform of state-owned enterprises 40 years ago,the benefit of workers have been heavily damaged,labor trouble occurred occasionally as well.The labor-capital relationship faced great challenge.Collective consultation has been applied as labor relationship mediation in accordance with market economy.However,facts proved that the collective consultation guided by country failed to resolve labor trouble but trapped the self safeguard of right for workers in state-owned enterprises.In the mean time,collective bargaining guided by workers arose rapidly in non-public ownership fields.Whether the market-oriented labor relationship coordination mechanism is available for workers in state-owned enterprises,or whether collective bargaining under the framework of gaming process of labor and capital is possible still remain uncertain in the studies before.This paper follows the method of case study,builds the study framework based on literature review and theoretical direction.According to the logic of multiple case study,literal replication is carried out in the only two successful cases in which labors forced capitalists from bottom to the top and started collective bargaining.(Integrated services company of Yanlian industrial group co.,Ltd & China National Erzhong Group Co.),theoretical replication is carried out in the typical failure case of Zhuhua in China National Salt Industry Corporation.By lengthways time serial analysis in single case and crosswise comparative analysis between cases,an empirical paradigm for the formation of collective bargaining in state-owned enterprises is built.By the methods of pattern matching and literature analysis,empirical paradigm matches the theoretical paradigm well.This paper makes correctness of theoretical paradigm with the empirical paradigm,forms the framework of collective bargaining formation in state-owned enterprises that can reflect the interactions between labors,capitalists and the government.From the study above,this paper finds out that a self-organization is formed with the process of collective bargaining and is in a continual evolution.Group consciousness is formed by the spirit of factory is homeland.Political identification is sped up with the agreement of anti corruption.Employee representation is established as an organizational support.On the other side,corresponding enterprises carries a response mechanism as well.Decisions are made according to the scale of labors' safeguarding rights and government tendency.However,with the characteristic that decision right is not owned by enterprises,the self execution of the process is quitelimited.Local government serves as an essential coordination in collective bargaining.Based on the conclusions above,to achieve a harmonious relationship between labor and capitalists,safe guarding rights should be well aligned with the function of employee representation.Capitalists should distribute benefit with the bilateral mechanism of collective bargaining.Local government should transform the concept in dispute settle that the government should be more active in intervention the conflict.The existing process and regulations should be effectively utilized.By all the means,the organizational system of collective bargaining in state-owned enterprises will be promoted.
