Chinese collective consultation system has been implemented for20years, especially the all-china federation of trade unions carried out "The rainbow plan" in2010, which increased the coverage of salary collective consultation. However its actual results are limited. Because this salary collective consultation is top-down and leading by government, also it lack of employees’involvement and labor union’s function. When it is difficult to promote, this bottom-up and market-oriented collective bargaining is in quietly to grow, which often begins with a collective action, ends in a collective bargaining. Also the demand-oriented collective bargaining launched by labors can solve labor-management disputes better than the supply-oriented collective bargaining drived by government, and demand-oriented collective bargaining is the development direction of China’s collective bargaining and coordination labor disputes. However, how does this bargaining model form? What factors contribute to the formation mechanism? They are still unsolved problems in theory. At the same time, due to Chinese background is different from he west, western collective bargaining theory can not explain China’s reality, China needs to build his theory of collective negotiations.On the basis of literature review, this essay builds a theory model of demand-oriented collective bargaining on wages formation mechanism. This essay chooses Yict, Honda and apex precision three enterprises as research objects and uses case study method, on-the-spot interviews, secondary data collection, grounded theory analysis to research the collective bargaining formation mechanism in China. The following conclusions can be proposed:the formation mechanism influence factors of demand-oriented collective bargaining on wages include the labors, the management, government, external forces and external environment of5level20factors. The demand-oriented collective bargaining on wages formed under the resultant force of the labor launch, the management concession, government push, and the third party assistance. This5influence factors’function are different. The workers are initiator, directly involved in the negotiation, who are the internal driving force of mechanism formation. The management are direct participants, whose compromise is a necessary condition for the formation of collective bargaining system. The government is the coordinator, and the key factor for the formation of collective bargaining mechanism, whose attitude and behavior directly determine whether the collective action can go to collective bargaining. Third party strength including media, lawyers, scholars, NGO are the external driving force of collective bargaining mechanism, which can increase the strength of labor and promote collective bargaining formation. Political, economic, and social external environment influence the formation and development of collective bargaining. The demand-oriented collective bargaining on wages formed under the resultant force of the labor launch, the management concession, government push, and the third party assistance. Lastly, in order to test this theory, this essay chooses collective bargaining cases of Qilitian golf products co., LTD and Wal-mart of Changde for case study.Based on the above research conclusion, and in order to better promote the formation of the collective bargaining mechanism and construct a harmonious labor relations, workers should strengthen competitive power, strengthen the construction of the union, the management should change ideas and build a win-win industrial communication system, the government should actively promote and establish an bargaining platform, external force such as media, lawyers, scholars, NGO shuld fully play a role.
