Research On Intellectual Property Risk Management Within Multinational Operation Of Chinese Enterprises

Nowadays,the accumulation of knowledge is of great significance to the development of the national economy and the establishment of competitive advantages of enterprises.Developed countries have taken up the “intellectual property stick” to profit globally and curb competitors early.For Chinese enterprises,they must have independent intellectual property rights to be able to cope with overseas intellectual property risks and expand the market.With the increasing status of Chinese enterprises in the world,developed countries often use intellectual property rights to suppress Chinese multinational enterprises,especially technology-intensive enterprises such as communication equipment manufacturing,which brings direct or indirect economic losses to enterprises and also hinders the process of multinational operation.Therefore,in-depth study of the type of intellectual property litigation risk and its influencing factors in the transnational operation of Chinese communication equipment manufacturing enterprises,and exploring the management strategy of intellectual property risk in the transnational operation of enterprises have far-reaching significance for the transnational operation of Chinese communication equipment manufacturing enterprises.This paper applies the risk management theory of management to the field of intellectual property rights by case analysis.By constructing a three-dimensional structure model in line with intellectual property risk management,the paper analyzes the intrinsic links between knowledge and property risk management in three dimensions: time,logic and knowledge.Then give corresponding prevention and control recommendations according to the corresponding intellectual property risks.Firstly,it analyzes the transnational operation status of Chinese communication equipment manufacturing enterprises and the intellectual property environment they deal with,and then takes the risk of intellectual property litigation as the main body of research,and classifies different types of intellectual property risks on the basis of different subjects that cause intellectual property risks,including intellectual property barrier risks,intellectual property risks arising from Non Practicing Entity,and intellectual property risks arising from competitors.Then,based on the analysis of the status of intellectual property risks,this paper makes an in-depth study of the influencing factors of intellectual property risks,among which the risk influencing factors are analyzed from both internal and external aspects.Then base on the theory,in this paper,representatives of two communication equipment manufacturers,ZET and Huawei,are selected to summarize and analyze their intellectual property risks and risk control measures.Then,using Hall three-dimensional structure model to analyze the intellectual property risk management difference of these two companies from time dimension,logic dimension and knowledge dimension,the author draws the experience and lessons of two enterprises in dealing with intellectual property risks in transnational operations.Finally,on the basis of case analysis,the recommendations of IPR risk prevention and control in the process of transnational operation of Chinese communication equipment manufacturing enterprises are proposed from the government,industry and enterprise levels.
