Study On The Third Party Mediation Mechanism Of Medical Dispute In Baoan District Of Shenzhen City

In current years,China had promoted the reform of medical and health system,and both the medical facility and technological level had been observably improved.Meanwhile,there was an in-depth reform of medical and health system,an increasing contradiction between people's growing demand of medical services and the relatively backward of China's medical development,a reinforce of people's right-protection awareness,and some malicious reports from the undesirable medias.All these resulted in an increasing medical disputes year by year.And the medical troubles happened occasionally.It significantly affected the development of China's health services and the construction of a harmonious s ociety.Therefore,establishing an impeccable third-party medical dispute mediation mechanism is of significance to the relationship between medical workers and patients,and to the harmonious social development.This article was on account of the concepts of medical disputes,the third-party mediation and the third-party medical dispute mediation mechanism.Basing on the theoretical knowledge of conflict management,the third-party mediation of public governance and crisis management,this article gives a systematic overview of the third-party mediation mechanism for medical disputes in Bao'an District of Shenzhen,in the aspects of legal basis,establishment background,organizational structure,source of funds and work flow.Secondly,through the analysis of typical cases and mediation data,,it summarized the saving graces and relevant inadequacy of the third-party medical dispute mediation mechanism.The saving graces included establishing the third-party mechanism,mediation in line with the same compensation standards,level-to-level disputes settlements and constructing remote video judicial confirmation system.And the inadequacy included lacking office expenses and space,professional talents,firm neutrality,smooth converge mechanism between court mediation and insurance claim.Finally,Learning experiences from advanced districts at home and abroad,and assuming the ideal pattern of the third-party mediation in Bao'an District Shenzhen City,this article also posed some strategies and suggestions in allusion to the local status.They included increasing financial input,cultivating professional mediation team,keeping the neutrality of the third-party mediation,strengthening the connection among different departments,building double insurance system,smoothing the convergence mechanism between court mediation and insurance claim,setting up the third-party mediation as demand requirement for medical disputes,and enhancing the publicity of the third-party medical dispute mediation.
