A Research On The "Third Party Mediation" Model Of Medical Disputes

The doctor-patient relationship refers to the specific interpersonal relationship between the medical staff and the patient in the medical process.In recent years,all kinds of conflicts caused by medical disputes and even murder,increasingly become the focus and emerge in an endless stream,the focus of the whole society.But China's current doctor-patient relationship mediation mechanism(reconciliation,administrative mediation and medical litigation)but because of the presence of irreparable defects in the legal,policy,professional and so on,can not take care of the interested parties,so the doctor-patient conflicts broke out this kind of medical trouble often turned into a dramatic way.Therefore,in view of the dilemma faced by the current medical and patient mediation,this paper chooses the "third party mediation"as a new way of mediation to solve the problems faced by the traditional mediation mechanism.In this paper,we use quantitative analysis method to demonstrate the three research methods:questionnaire,interview and case analysis.The process of argumentation is as follows:Firstly,by combing the study of doctor-patient relations at home and abroad,and investigating the doctors and patients in five hospitals of A City,the causes and main channels of mediation are analyzed.Secondly,from the perspective of neutrality,professionalism,timeliness,cost and cost,this paper analyzes the advantages of the third mediators and the three mediation mechanisms,and visits the mediation cases of the A municipal medical Regulatory Commission(third party mediation institutions)and three hospitals,and conducts a questionnaire survey of the people with different mediation mechanisms in the cases.Then,the statistical analysis of the survey results is carried out to verify the feasibility and effectiveness of the third party mediation.Thirdly,according to the development status of the third party mediation institutions in A city and the actual mediation cases,case analysis is carried out to explain the difficulties faced by the third party mediation,such as running funds,independence,talent distribution,supporting policies and so on.Finally,on the basis of the advanced mode and good experience of the third party mediation at home and abroad,this paper takes the third party mediation dilemma of A city as an example to analyze the countermeasures,in order to improve the domestic third party mediation model.
