Study On The Operation Mechanism Of The People’s Mediation Committee In Guangdong Harmonious Doctor-Patient Disputes

In recent years,China has continuously promoted the reform of medical and health system,the people’s awareness of health and legal rights is increasing day by year,the incidence of doctor-patient disputes has become more and more important,the construction and perfection of medical dispute mediation mechanism In June 2011,Guangdong Medical Council was officially listed and began to operate,is the largest people’s mediation organization in Guangdong Province,its responsibility for the transfer of medical institutions in the province and patients between the two sides of the dispute,in the country has a certain representative.This paper mainly adopts the literature analysis,comparative research and Case study method,analyzes the development course and present situation of the people’s mediation mechanism of medical disputes in China,the present situation and characteristics of medical disputes in Guangdong,and summarizes the different modes and forms of people’s mediation in medical disputes between China and other countries.By combing and analyzing the operation situation and concrete cases of Guangdong Medical Council,this paper puts forward that Guangdong Medical Council can effectively mediate medical disputes,but there are still the following problems: The operation loss of underwriting company,the mode of "adjusting combination" lead to the challenge of the neutrality and impartiality of mediation,the way of adjustment relying too much on the evaluation result,The preventive mechanism needs to be perfected,and the internal management of the institution needs to be strengthened.The reason for this is that the coverage rate of medical institutions is not high and the premiums are low,the operating funds of the institutions originate from insurance companies,the Medical Council does not havethe right of investigation and appraisal,the follow-up guidelines for preventive mechanisms are not perfect,and there is a lack of compound professionals combining medical law.In view of the above problems,the following Suggestions are put forward: in improving the operating mechanism,we should strengthen the strength of medical insurance,increase the operation funds through multiple channels,optimize the combination mechanism of redeployment,train professional medical dispute mediators and strengthen publicity and public opinion guidance,etc.,in the improvement of the relevant cohesion mechanism,we should improve the mediation and identification mechanism,The establishment of judicial recognition mechanism and the inclusion of pre-litigation mediation as a legal procedure,thus increasing the legitimacy and authority of mediation.
