"Unconventional Action" Research In Third-party Mediation Of Doctor-patient Disputes

In recent years,the doctor-patient conflict is escalating in China.The severity of violence between doctors and patients and the extent of violence are constantly refreshing people's awareness.How to solve the doctor-patient disputes in an efficient and reasonable way so as to ease the contradiction between doctors and patients has become a problem that our society must face nowadays.Under such circumstances,the People's Medical Committee of Disputes between Doctors and Patients(PMCDDP)as the core of the third-party mediation mechanism has established,and being promoted in the country."Non-routine action" refers to those "do not follow the routines" action,these actions deeply rooted in the society,but did not get enough attention.In the critical period of the reform of the third party mediation mechanism of doctors and patients,the shadow of "non-routine action" is still active in it,even in the general trend.Therefore,the author studies the development of the third party mediation mechanism of doctors and patients disputes from the perspective of "non-routine action",examines their performance and characteristics,explores the conditions under which they exist,and optimizes the third party mediation mechanism from the perspective of "non-routine action" It is very important.Based on the perspective of "non-routine action",this paper summarizes the "non-routine action" in the third party mediation mechanism of the doctor-patient dispute,which is the main performance in the development process of PMCDDP in J.With practicality,autonomy,non-universal,non-organizational characteristics."Non-routine action" of the conditions of production,including their own practicality and the plight of the long-term role,at the same time,“the hidden right” is also an important condition.Finally,from the perspective of "non-routine action",the key point of optimizing the third party mediation mechanism is as follows: it is necessary to recognize the "non-routine action" and the adjustment mechanism,find "non-routine action" and "Routine action " to prevent the occurrence of hazardous actions.
