Ethical Examination Of Doctor-Patient Conflict Prevention And Control Policy In China

With the development of society,the doctor-patient relationship highlights a complex situation,threatening the personal safety of medical workers and hindering the normal order of medical treatment,and the stability of social order is greatly affected.Since 1987,our country has continuously adjusted and updated the prevention and control policy of doctor-patient conflict,showing the characteristics of emergency,high-pressure and penalization.However,the gradual improvement of prevention and control policies has failed to curb the re-occurrence of malignant medical injuries such as "medical disturbances" and "medical violence",and the prevention and control policies have failed to meet expectations.This year is the decisive period for building a well-off society in an all-round way.Poor prevention and control of doctor-patient conflicts will lay hidden dangers to the normal order of society and will inevitably bring adverse effects to the process of building a well-off society in an all-round way.Therefore,it is of great practical significance to realize the "immediate effectiveness" and "fundamental effectiveness" of theprevention and control policy of doctor-patient conflict.From the perspective of ethics,the author examines the evolution process of the prevention and control policy of Doctor-patient Conflict in China.With policy appeal as the core,the author explores the ethical principles of the prevention and control policy,analyses the ethical legitimacy and ethical conflicts of the prevention and control policy,and looks forward to the ethical value of the prevention and control policy,so as to provide theoretical support for formulating the ultimate effective prevention and control policy of doctor-patient conflict.The article is divided into five parts.First is the preface.In this part,the research background,purpose and significance of the article,research status at home and abroad,research methods and research difficulties and innovation are briefly described.The first part: An overview of the basic theory.Through analyzing the concepts of "medical disputes","doctor-patient disputes" and "doctor-patient conflicts",this paper finds out the internal relations among them,summarizes the characteristics of "doctor-patient conflicts",and then elaborates the two typical forms of doctor-patient conflicts,such as "doctor-patient disputes" and "medical violence",and discusses the correlation and difference between them,with a view to accurately controlling the focus of prevention and control of doctor-patient conflicts.Based on the elaboration of the connotation,characteristics,functions andethical value of public policy,this paper further studies the basic concepts and functions,value expectations and ethical principles of the prevention and control policy of doctor-patient conflict,so as to lay a theoretical foundation for the follow-up analysis of the ethical legitimacy and ethical conflict of the prevention and control policy.The second part: The evolution of the prevention and control policy of Doctor-patient Conflict in China.Since 1987,the prevention and control policy of Doctor-patient Conflict in China has gone through four stages.By combing the evolution of prevention and control policies,this paper summarizes the renewal and adjustment paths of emergency,high-pressure and punishment of prevention and control policies,and combines the effect of prevention and control policies,analyses the deficiencies of prevention and control policies in terms of effectiveness and provides the current basis for the analysis of ethical legitimacy and ethical conflicts of prevention and control policies.The third part: The ethical legitimacy of the prevention and control policy of doctor-patient conflict.The article analyses the legitimacy of the prevention and control policy from four dimensions: the Supreme goodness,the appropriateness,the moderation and the concept of the prevention and control policy.As a kind of "good means",prevention and control policy practices "intrinsic good" activities aiming at "properly handling doctor-patient conflicts,protecting the legitimate rights and interests ofboth doctors and patients,building harmonious doctor-patient relationship and maintaining stable medical order",which is a response to social demands and also a legitimate need to conform to social development.The promulgation of the Regulations on the Prevention and Treatment of Medical Disputes is a sign that the concept of prevention and control of doctor-patient conflicts in our country is moving towards "balance".The forth part: Ethical conflict of prevention and control policy of doctor-patient conflict.The article discusses the ethical conflict of prevention and control policy from three aspects: public interest and personal interest in the formulation of prevention and control policy,efficiency and fairness in content,and ethical issues in the implementation of prevention and control policy,combining with the ethical principles of prevention and control policy.In order to accurately locate the fundamental crux of doctor-patient conflict,and provide a reference direction for the formulation of prevention and control policy of Doctor-patient Conflict with both "immediate effectiveness" and "fundamental effectiveness".The fifth part: Consideration and Prospect of the ethical value of prevention and control policy.As a policy to deal with social problems,the prevention and control policy of Doctor-patient Conflict focuses more on public interests,emphasizes social fairness and justice,and bears certain social responsibilities.Combining the evolution and ethical principles,ethical legitimacy discussion and ethical conflict analysis of the precedingDoctor-patient Conflict Prevention and control policy,the value orientation of Doctor-patient Conflict Prevention and control policy is obtained,and it prospects that the formulation of prevention and control policy should be "people-oriented";Prevention and Control Policy should realize the organic unity of public interest and individual interest and "Sustainable Good";Prevention and control of Doctor-patient Conflict should be transformed into confrontation into governance.
