Compared with the past,the current construction project has greater scale and becomes more complicated and more uncertain,which brings more risks to the construction enterprises.In front of this situation,the construction enterprise needs to refine and standardize the construction contract,so as to effectively control risks and protect their own interests.The construction contract defines the rights,responsibilities and benefits of all parties,which is an important basis and link for the cooperation between the owner and the construction enterprise,and also an important guarantee for the profitability of the construction enterprise.Therefore,how to effectively manage contract risk is an important problem that construction enterprises need to solve.(1)From the perspective of construction enterprises,this paper studies the risk management of construction contract.Through the analysis of S company’s construction contract signing and contract disputes,the paper points out the problems of its contract risk management.Using the method of expert interview to identify the risks in the construction contract of S company,building the risk evaluation system,using the questionnaire to analyze the identified risks quantitatively from the probability of risk occurrence and the impact degree of consequences,combining with the risk matrix to determine the three levels of high,medium and low risks,and accordingly to formulate the corresponding risk response strategies.The main conclusions are as follows:(1)Through the analysis of the amount of construction contract signed,contract disputes,contract management organization structure and process of S company in the past five years,it is found that there are many problems,clear the way to solve the problem through risk management.(2)To manage the risk of construction contract of S company,a risk assessment group was established to identify 17 construction contract risks by using expert interview method,and the risk was described based on the actual case,and the risk list of construction contract of S company was determined.Five levels of risk occurrence probability and consequence influence degree are described qualitatively and quantitatively,and the standard of risk analysis is determined.Build a risk evaluation system,score the occurrence probability and consequence impact degree of the 17 construction contract risks identified above by using the questionnaire,determine the risk evaluation level by using the risk matrix,and find 5 high risks,economic risks,including government policy adjustment risk,market price rise of production factors,force majeure risk,contract text risk and contract dispute risk;The whole process of contract management involves five mid level risks:the risk of weak legal awareness,the risk of project bidding decision,the risk of credit of the counter party to the contract,the risk of authorized signer,the risk of contract performance;the risk of contract management organization structure,the risk of contract management system,the risk of contract negotiation,the risk of fixed total contract price,the risk of contract change,the risk of contract termination,the risk of contract settlement,etc are other 7 low risks.(3)According to the risk response strategy,such risk response measures like avoiding or transferring the high risks of the construction contract of S company,reducing the mid level risks and accepting the low risks are adopted.
