Ship recycling industry is known as "smokeless metallurgical industry".A large amount of scrap steel and other recyclable materials and equipment can be obtained through the recycling of scrap ships.Therefore,the ship recycling industry should be a resource-saving industry conducive to the recycling of resources.But at the same time,Ship recycling industry is also an industry prone to high pollution.If there is no proper legal system to effectively manage Scrapping yard,ship recycling activities,ships to be recycled,it is easy to occur pollution incidents caused by harmful substance leakage in ship recycling operations.In order to effectively regulate scrapping yard,ship recycling activities,ships to be recycled,a series of international laws and regulations have been promulgated.The Hong Kong Convention on International Safe and Environmentally Sound Ship Dismantling(hereinafter referred to as the "Hong Kong Convention")promulgated in 2009 and the EU Regulation on Ship Recycling(hereinafter referred to as the "EU Regulation")promulgated in 2013 are the major players.As a big ship-recycling country in the world,the relevant laws to prevent pollution from ship recycling are mainly the Regulations on the Prevention of Environmental Pollution from Ship recycling,supplemented by some regulatory documents such as departmental regulations,industry norms and national standards.Compared with the relevant international legislation,China's Ship recycling legislation has many shortcomings,and even some provisions are outdated.The publication of the Hong Kong Convention and the EU Regulations provides a reference for China to improve its domestic legislation.Therefore,based on the legal system of preventing pollution caused by ship dismantling in our country,this paper puts forward some suggestions to improve the relevant legislation in our country,focusing on the combination of the Hong Kong Convention and the EU Regulation.This paper consists of six parts.In the introduction,the meaning of ship dismantling and the development of ship dismantling industry in China are introduced.Chapter 1:Overview of pollution caused by ship recycling and ship recycling.In the overview of ship recycling,the definition of ship recycling,the significance and value of ship recycling industry and the general situation of China's ship recycling industry are introduced.In the section of overview of pollution caused by ship recycling,the types of pollution caused by ship recycling and the control policy of pollution caused by ship recycling are introduced.Chapter 2:The problems existing in China's laws to prevent pollution caused by ship recycling are discussed in detail.The domestic normative documents to regulate pollution caused by ship dismantling are introduced.The problems existing in these documents are analyzed,such as the lack of maneuverability of some provisions,the low entry threshold for ship dismantling enterprises,the low and confused standards for preventing pollution caused by ship dismantling,and the lack of economic security system matching with pollution caused by ship recycling.Chapter 3:The anti-pollution system of ship recycling in the Hong Kong Convention and EU Regulation summarizes and summarizes the legal system of preventing ship recycling from polluting the environment in the Hong Kong Convention and EU Regulations,and analyses the rationality of the content of the regulations and the impact of the two regulations on our country.Chapter IV:Suggestions on perfecting the legal system for preventing pollution from ship recycling in China.Based on the problems existing in the relevant laws of China,and combining with the reasonable system of the Hong Kong Convention and the EU Regulation,the author proposes to establish a list of harmful substances and a certificate system for ship recycling,strengthen the access examination and daily supervision of ship recycling enterprises,and formulate high-standard and unified ship dismantling process specifications.Suggestions on the establishment of a green ship recycling fund and a systematic economic security system combining compulsory pollution liability insurance for ship dismantling.Finally,the conclusion summarizes the content of the full text.
