A Study On The Legislation Of The Construction Of Guizhou National Park Province

"National Park Province" refers to that Guizhou Province upholds the concept of ecological civilization,making use of its natural ecological resources,natural and cultural resources advantages,according to the national positioning of Guizhou Province’s main functional areas,reforming the system of natural protection sites,balancing the relationship between natural protection and development and utilization,developing ecological tourism,and promoting sustainable economic and social development.Guizhou Province has superior natural resources and rich biodiversity.It has good natural and human conditions to build a "National Park Province".In addition,a series of laws,regulations and policy documents concerning the construction of ecological civilization and the development of national park system provide rare opportunities and challenges for the construction of Guizhou National Park Province.Legislation puts forward new requirements.The strategy of "National Park Province" must firmly grasp the two bottom lines of "development" and "ecology",protect the ecological resources,and seek the all-round development of Guizhou’s economy and society in the process of protection.Based on the "ecology" in the development strategy of "National Park Province",this paper mainly studies the development of Guizhou’s national park system and the related legislation of the nature reserve system.To build a natural protection area system with national parks as the main body,to maximize the value orientation of the state for the development of Guizhou’s main functional areas,to do a good job in the construction of ecological civilization demonstration areas,to ensure the functions and values of Guizhou as an important ecological security barrier in the upper reaches of the Yangtze River and Pearl River,and to promotethe sustainable development of regional economy.The first chapter introduces the relevant legislation theory of Guizhou National Park Province,defines the concepts of "National Park","Natural Conservation Area and Natural Conservation Area System","National Park Province",analyses the necessity and feasibility of legislation,expounds the theoretical and practical value of legislation;the second chapter draws lessons from the development experience of foreign national parks,and provides legislative tools for Guizhou National Park Province.Chapter three introduces the current situation and deficiencies of Guizhou National Park Provincial Construction legislation;Chapter four puts forward suggestions for legislative improvement of Guizhou National Park Provincial Construction: scientific planning,unified leadership,construction of Guizhou National Park Provincial legal system,and formulation of "Guizhou National Park Provincial Construction Promotion Regulations".This paper makes an analysis of the rights and obligations of the relevant subjects of responsibility in the construction law of Guizhou National Park Province,including the government and relevant departments,investors and operators,tourists,communities and social institutions;and improves the relevant institutional mechanisms,including supervision and management mechanism,fund guarantee mechanism,benefit distribution mechanism,ecological compensation mechanism,community participation mechanism,franchising system,etc.
