Rich marine resources are the important foundation to support the sustainable development of economy and society.Due to population pressure,ideology and over-exploitation,environmental problems are becoming more and more serious.Improving the marine ecological compensation system has become a realistic choice to coordinate economic development and marine ecological protection and promote the sustainable development of environmental resources.Since China has developed most of the land resources in the territory to different degrees,the land natural resources have been attacked to different degrees,and turning to the sea has become the inevitable and realistic choice for a long period of time in the future.In the early stage of developing marine resources in China,the ecological environment has been seriously damaged because of the deviation and wrong understanding of its ecological value,which restricts the sustainable development of marine economy in China for a long time.The 18 th Congress of the Party pointed out: to establish ecological compensation system.Land and sea should be treated equally,not only should they be established,but also the marine ecological compensation system should be put into practice truthfully.It is of great significance to the ecological balance and protection of the ocean.The article starts from the following five parts altogether.The first part is the introduction,introduces the research background of marine ecology in our country,proceeds from the theory and the practice value,in order to promote the marine ecology "the government market enterprise" the diversification compensation main body,through the intelligence compensation,Marine ecological self-compensation and other new compensation methods to achieve innovation.In the second part,the necessity of marine ecological compensation in China is obtained by analyzing the concept and characteristics of marine ecological compensation,which is supported by the economic theory and the legal theory of marine ecological compensation.The third part analyzes the realistic predicament of the current marine ecological compensation legal system in China.Judging from the current legal system of marine ecological compensation in our country,for example,the legal structure of marine ecological compensation is not perfect,there is no special legislation,the existing laws are integrated and coordination is not strong,the main body,scope,and mode of marine ecological compensation are not strong.The standards are relatively backward and the legal liability is absent.In the fourth part,the author chooses the advanced countries in the marine ecological compensation legal system and the implementation,in order to find out the deficiency of the current marine ecological compensation legal system of our country.It provides valuable experience for the establishment of the relevant legal system of our country,mainly including the establishment of the compensation standard system in Germany and the National Trust Fund of the United States.System.The fifth part designs the legal system of marine ecological compensation in China on the basis of the problems raised in the third part,including perfecting the legal system structure of marine ecological compensation in China.Improve the legal system of marine ecological compensation and standardize the legal responsibility of marine ecological compensation.
