Research On Marine Ecological Compensation Legal System In China

Marine resources are rich in economic,social and ecological values.In recent years,more and more attention has been paid to the development of marine economy in the world,which has become the new trend of the world,this is destined to make marine resources become the basis of human survival and development in the future.China has been rich in marine resources since ancient times,but since the reform and opening up by the impact of market economy,our nationals in the pursuit of economic interests driven by the maximization of attention only to tap the economic value of marine resources and social values,And the value of ecological value as the value of marine resources itself has been neglected.At present,the establishment of China’s marine ecological compensation system is increasingly important,but from the current domestic marine ecological compensation to develop legal norms there is a serious gap,and even can not find the relevant legal norms.Therefore,it is urgent to conduct a comprehensive study of the marine ecological compensation system and put forward the corresponding countermeasures,which is of great significance to maintain the ecological value of marine resources in China.This article is divided into four parts of China’s marine ecological compensation legal system for all-round,deep-seated research.The first part is the basic theory of marine ecological compensation legal system.Included on the Marine ecological compensation related concept definition and the content of the related to Marine ecological compensation legal relationship,because the understanding of relevant concepts is the starting point of research.The second part analyzes the current situation of China’s marine ecological compensation policy and legislation.Through the analysis of these policies and laws and regulations,it is possible to have a clearer understanding of the characteristics of marine ecological compensation,as well as the exploration of China’s marine ecological compensation legislation and the practical objectives of determining marine ecological compensation.The third part is the analysis of the defects and causes of the legal system of marine ecological compensation in China.This part summarizes the problems arising from the practice of marine ecological compensation law,and points out that the legal system of marine ecological compensation has the disadvantages of arbitrarily or illegality in the scope of compensation,main body and mode of operation.The fourth part is about the perfection of China’s marine ecological compensation legal system.This part is related to the shortcomings of the legal system of marine ecological compensation in China,and puts forward some concrete suggestions to perfect the legal system of marine ecological compensation in China.This part puts forward some suggestions on improving the marine ecological legal system,clarifying the marine ecological standard and establishing the special supervision mechanism of marine ecological compensation.Through the compensation standards,compensation scope,compensation and other aspects of the compensation mechanism to address the relevant stakeholders in the marine ecological compensation mechanism in the status of marine development and protection more coordinated,and to ensure the effective implementation of marine ecological compensation funds.
