Study On The Legal System Of Compensation For Ecological Damage Of Marine Oil Pollution

With the development of social and economic, we need more and more resource.So the government pay more attention to the development and transfer of resources.And the oceans contain huge oil resources, countries compete to develop marine. Onthe other hand, the advantages of marine transportation is another factor that make theocean becoming the main mode of transfer. At the same time a large number ofmarine oil spill dumped into the ocean, causing huge pollution. The greatest damagecaused by marine oil spill is the damage to the marine environment, but the hugedamage can’t be indemnified because there is no perfect laws and regulations. This isthe key problem we forced in the protection of the marine ecological environment.Firstly, we explore the definition of marine ecological damage. At the same timewe combine the different academic views and the current situation of our country, wetry to find the accurate definition of marine ecological damage. And then in the thesiswe will analysis the damage of the marine oil spill to marine ecological.Secondly, this paper focuses on several international conventions and foreignlegislation on marine ecological damages. We think the range of reparation and thebody who can ask for the reparation are the basic problem. In the paper we comparedinternational conventions with the law of our country on these two areas. Based on theanalysis, we will know the defects of law about marine oil pollution ecologicaldamages. And then we can provide some recommendations.Finally, some other systems of marine oil pollution ecological damages needfurther refinement, such as Oil Pollution the ecological damage Fund, compulsoryinsurance, damage assessment and so on. Based on the study we can establish thelegal system of marine oil pollution ecological damage.
