The Predicament And It’s Solution Of The Law Enforcement On Environmental Protection By Local Government

After the CPC 18 th National Congress,the environmental protection was newly amended and implemented,It’s was called the toughest in historyact.The air pollution prevention and control law,,environmental impact assessment law and other special laws have been revised and implemented accordingly,although the implementation of the new law has made some achievements,but there is still a big gap between the goal of environmental quality improvement.Environmental protection,pollution control,ecological restoration and other tasks are still heavy,the situation of environmental quality decline is still grim.As an important starting point of environmental protection and environmental supervision,local environmental law enforcement work plays an important role in ensuring that the central environmental protection policies and policies fall to the ground and effectively improve environmental quality.Therefore,in view of the problems existing in the process of environmental protection law enforcement of local government in our country,strengthening the research on environmental law enforcement of local government will be of great significance to the improvement of environmental protection law enforcement and environmental quality in our country.This paper studies the local government environmental protection law enforcement difficulties and their solutions,and take the emeishan city as a specific research object.Through summarizing the achievements and difficulties of environmental protection law enforcement of Emei city government,this paper analyzes the reasons for the difficulties of environmental protection law enforcement of Emei city,and puts forward some countermeasures for solving the difficulties.First of all,this paper had briefly studied the relevant concepts and theories of environmental law enforcement.With the help of relevant literature,this paper analyzes the four difficulties of environmental law enforcement in emeishan city,such as local intervention,lack of cooperation of environmental law enforcement departments,lagging capacity building of environmental law enforcement,lack of effective supervision of environmental law enforcement,and analyzes the reasons for these difficulties.Then the author introduced the three environmental enforcement modes of Beijing-Tianjin-Hebei air pollution strengthening supervision and law enforcement,Sichuan air pollution strengthening supervision and law enforcement and Leshan city environmental protection cross supervision and law enforcement,compared and analyzed the successfulexperience of the three modes of supervision and law enforcement,and combined with the relevant literature and information,by drawing on the advanced practices of the three modes of supervision and law enforcement,and extracted the countermeasures to solve the current difficulties of local government environmental protection and law enforcement.This paper puts forward some measures and concrete measures,such as strictly implementing the responsibility of the main body of environmental protection,rationalizing the coordination mechanism of environmental law enforcement departments,paying more attention to the construction of environmental law enforcement capacity,and perfecting the diversified supervision mechanism of environmental law enforcement.Through this study and analysis,this paper hopes to improve the specific work of environmental law enforcement in emeishan city to provide an effective reference,but also for other local environmental law enforcement work to play a certain reference.
