On The Plight Of Chinese Environmental Law Enforcement And Means Of Perfection

In recent years, major pollution accidents occur frequently in China.2010 has seen a series of serious environmental accidents----9 cases of lead poisoning ensued in Jiangsu, Sichuan, Hunan, Gansu, Hubei, Anhui and other provinces, the mining pollution in Zijing, oil leakage in Dalian sea area, the pollution of chemical barrels in Songhua river, the thallium pollution in a smelting plant in Shaoguan, etc. During the 30 years of Chinese rule of environmental law, we have been facing embarrassing situation --- worsened environmental quality, failure of evaluationg and prevention mechanism in environmental issues, hard implementation of accountability, and the unpractice of environmental damage compensation. With the rapid economic growth, laws about environmental protection have been established in batches, environmental protection institutions constantly expanded, and various ranks of the environmental protection teams increasingly promoted year by year. However, the quality conditions of the environment has not been fundamentally improved, conversely, locally deteriorated. The root of this situation in the ruling of law mainly lies in the slack enforcement of environmental laws. The system of environmental protection laws haven't played its role effectively. The unefficiency in the enforcement of environmental laws, together with the environmental degradation degree manifests that there exists loads of problems in Chinese environmental law enforcement.The enforcement of environmental law, as the crucial link in the implementation of environmental in our country, has gained an increasingly significant status in the work of environmental protection. The effectiveness and efficiency of environmental law enforcement directly affects the realization of the objective and goal of environmental laws and regulations. This article takes the enforcement of environmental laws as the starting angle and analyse in four perspectives the plight of Chinese environmental law enforcement and the coping mechanism, namely, the first part--- related concepts and the characteristics of environmental law enforcement, the subject and relative person in environmental law enforcement and the concept of environmental law enforcement; the second part---outline of Chinese environmental law enforcement status and trouble analysis based on relevant case; the third part--- systematical introduction of the enforcement of American related environmental laws and characteristics; the fourth part, learning from American experiences, summary of the relevant approaches to promoting China's environmental law enforcement early out of trouble in four sub-perspectives---renewing environmental law enforcement concept and strengthening the consciousness of environmental protection; perfect environment management system and the environmental law enforcement mechanism; improve environmental legal system and the environmental law enforcement means; enhance environmental enforcement capabilities and strengthen the law enforcement team construction.
