The developmental level of special education is important symbol of a national civilization degree. The development of special education in all countries is due to the special education laws and regulations are implemented constantly. A series of laws and regulations related to special education in India, the plan to be implemented to promote the development of special education and the rapid development of modern special education in India. Revised "educational law" proposed that "our country should take measures to promote the educational fair, and promote the educational balanced development"; "two sessions" also emphasized "the country should view the development of special education as one of the goals of the work". Zhu Yong Xin committee proposed that during the period of "ten three five" vigorously develop the special education. So showing that attaches more importance to developing special education in our country. But at present our country still has nearly one hundred thousand school-age out-of-school special children, they are excluded from the community and society. So it is necessary to learn from special educational legislation experience in India, and consummate the special educational legislation system for our country, make sure that legitimate rights and interests of all the special children. The research mainly includes the following seven parts.The first part is the introduction, sums up the importance of perfecting the legislation of special education and successively promulgated the policy laws and regulations about the special education in India that bring the thinking about special education laws and regulations in mainland China. The second part mainly includes two aspects:The first aspect is conceptions about special education and Special education legislation. The second aspect summarizes that the domestic and foreign scholars about the research of the development of the special education and legislation situation in India. And it founds that the current special educational legislations research in India mainly tend to India constitution 1949 and the national education policy 1986, special children's pre-school education, special children's social security legal system, integrated education and inclusive education.The third part introduces the source of the problem, researching meaning, researching methods and researching thought. The source of the problem are that developmental needs special education in our country and the enlightenment of literatures at home and abroad; the significance of the research contains that the theoretical significance and the practical significance. The theoretical significance are provide theoretical guidance for special education legislation and special education workers in our country, and provide theoretical basis for special children's parents to enhance their confidence; the practical significance are helpful to reducing the pressure of the parents of special children, promoting special educational workers own quality and the work efficiency, to ensure special children can receive a fair education. The researching methods are literature analysis method and comparison method. The fourth part introduces special education legislation evolution and features in India.The fifth part according to special education legislation evolution in India, getting some enlightenment for special education legislation in mainland China:special children's pre-school education will be included in the category of compulsory education in the form of legislation; Related to special education in our country legal term will be materialized, to realize the special education laws; Special education teacher training work will be taken seriously, to improve training quality; Conception of special education development in our country will be able to carry out, implement home-school-social education community.The sixth part summarizes that perfect special education legislation system is the key factor to guarantee all special children get fair education. For my own and external factors, the study has still many deficiencies, and puts forward the direction of further research.
