The Study On Archives Legal System Construction In Anhui Province

Archival work is involved in every aspect of socialist construction.It can help maintain the real history of the CPC and the country,so its significance is self-evident.Only when the archival work is included on the track of legislation can archival work have laws to abide by.This is not only a concrete reflection of the basic national strategy,rule by law,in the field of archives,but also a must-taken development path of archival work.Archival legal system is a legal order formed along long with operation of links,including legislation,enforcement,justice,and law popularization.Therefore,strengthening of the archival legal system construction can effectively overcome the lagging nature of archival legislation,standardize its administrative law enforcement,enhance monitoring of its administrative law enforcement,improve the administrative remedy,and promote publicity of archival laws.This paper mainly consists of five sections.The first section introduces research purpose,significance,development status at home and abroad,research methods and innovative points of studying archival legal construction in Anhui Province.It aims to analyze the research value and progress of this paper,and point out its feasibility and necessity.Through this section,the author gets a basic understanding of archival legal construction in Anhui Province.The second section describes the status of archival legal construction in Anhui Province.Through multiple channels,including online searching,searching journal articles and field survey,the author collects a series of materials related to archival legal construction in Anhui Province.Based on the above analysis and conclusion,a series of archival legal construction links are adopted as discussion aspects,attempting to comprehensively introduce archival policies and regulations,law enforcement achievements,and archival administrative remedy,and progress of archival law popularization in Anhui Province.The third section discusses about problems popping up during the archival legal construction process in Anhui Province.It is found out that,during the archival legislation process,some archival laws and regulations are backward;the archival legal system is incomplete;and the archival laws and regulations lack local characteristics.During the archival administrative law enforcement process,the archival administrative enforcement procedures are relatively chaotic and there lacks an efficient administrative law enforcement monitoring mechanism.The archival relief system of Anhui Province is not satisfying either.To be specific,some scattered archival administrative relief systems are far from being complete.During the practical implementation process,they are less operational.Finally,though archival law popularization has made certain progress in Anhui,the archival law popularization modes are to backward.The archival law popularization emphasizes too much on forms but less on practical effects.An effect assessment and monitoring mechanism has not yet been put in place.Concerning all the above problems,the fourth section of this paper puts forward suggestions to strengthen archival legal construction in Anhui Province.In terms of archival legislation,some outdated laws and regulations should be continuously improved to meet era development requirements.Besides,legislation should be innovative and develop local characteristics so as to improve the Anhui's archival law system.In terms of archival administrative law enforcement,improvement efforts should be made in two aspects,including improvement of the archival law enforcement procedures and restrictions of the monitoring institutions.Moreover,archival law popularization is crying for further strengthening.Innovation of law popularization,formulation of more efficient and acceptable popularization modes,and establishment of the archival law enforcement effect mechanism can change formalism of the archival law popularization.The fifth section is a brief summary of the whole paper,and points out limits of this research.Form this research,it can be seen that there are still some weak links in archival legal construction of Anhui Province.Therefore,it is still a long way to go to strengthen archival legal construction of Anhui Province.
