Research On Legal System Of Ecological Compensation For Agricultural Land Rehabilitation

Cultivated field is the basis for human survival and development.The Party's report at the 18 th National Congress of the CPC put forward: “Optimize the pattern of national land space development,strengthen the construction of ecological civilization,and improve the basic management system.Improving the strict arable land protection system,establishing a system of paid use of resources and an ecological compensation system.” Affected by the market economy and traditional resource conservation models,people only paid attention to the economic value of arable land and strictly followed the red line of 1.82 million mu of arable land.The ecological value of cultivated land,neglecting the protection of cultivated land quality.Cultivated land as an essential attribute of natural resources is neglected,leading to serious problems such as severe farmland pollution,decreased soil fertility,water and soil erosion causing food safety,and farmers' income loss.All-round protection of cultivated land is imminent,and both the quality and quantity of cultivated land must be protected.The construction of an ecological compensation legal system for cultivated land rest is one of its important paths.This article from the agricultural land fallow as the starting point,combined with the development of the concept of ecological civilization,systematically introduce the necessity of agricultural land,fallow agricultural land for ecological compensation system and the existing problems,the legal status of the rest of the ecological compensation system from agricultural land in China and the practice situation,analyze the problems and causes on the perfection of the realistic foundation,our country's farmland for ecological compensation system,summarizes the foreign agricultural land fallow compensation experience,with farmland ecological compensation system for the long-term effective operation,strengthen the legal guarantee,determine the compensation standard,scientific and reasonable to explore diversified compensation methods,determine the compensation period,a reasonable expansion of rest ecological compensation of agricultural land sources such as suggestions.In order to further enrich the theoretical system of ecological compensation in our country,make the agricultural land ecological compensation in the form of legislative methods detailed provisions in the draft of the "Ecological Compensation Ordinance".
