Study On The Legal Issues Of Fishery Ecological Compensation In China

In order to alleviate the problems of waste of resources and ecological damage in the current national development process,the work and life of the public are usually affected by economic means,and thus a form of protection,namely ecological compensation,has gradually formed.Since its development,this method has received extensive attention from the academic circle,and relevant suggestions have been put forward in theory and practical practice,which play a vital role in ecological protection.At present,domestic and foreign scholars’ relevant research on ecological compensation mainly focuses on the discussion of ecological protection and economic value,but there is little research on related legal issues,especially in the area of fishery ecological compensation.The current law still leaves a blank in this respect.Therefore,this article starts from this aspect,namely the law of fishery ecological compensation,specifically designs the legal system of fishery ecological compensation,perfects and sorts out the content of fishery ecological compensation system,and provides theoretical support and reference for the construction of fishery ecological compensation mechanism in our country.The first part of this paper mainly introduces the concept of fishery ecological compensation and the theoretical basis of fishery ecological compensation,through the definition of the concept of fishery ecological compensation and the analysis of the relevant basic theory,it lays a theoretical foundation for the following in-depth study;the second part deeply explores the current situation of fishery ecological compensation in China and the current situation of fishery ecological compensation in the United States,and draws on the effective experience of fishery ecological compensation in the United States in light of the current situation of fishery ecological compensation in China;the third part mainly exposes the problems existing in fishery ecological compensation in China and puts forward corresponding countermeasures,mainly including the problems of imperfect legal system,narrow scope of subject and object,single compensation mode and the lack of fishery ecological compensation management by the government,and puts forward countermeasures and suggestions for improving fishery ecological compensation in China based on the analysis of the previous text..
