Researching On The Legal Regulation Of ENGO In China

In the society of rapid development of ecological civilization,ENGO has become the backbone in the field of environmental protection.During the construction of the rule of environmental law,ENGO is also expected to be.As an important expression of the public interest and a systematized social force,the influence of ENGO which committed to the public welfare in environmental protection has penetrated all aspects of environmental protection.ENGO usually participates in government's environmental legislation and decision-making by expressing their opinions,participating in demonstrations and hearings in order to restrict government's environmental power.ENGO boosts the enforcement of environmental protection law by prosecution,lawsuit for public interests and so on,which helps make up for the public enforcement deficiency of environment law under the influence "government failure" and "market failure".What's more,ENGO is good at promoting the concept of the environment and carrying out training and educating so as to expand the mass base of the " Ecological civilization " and " environmental rule of law " concept.ENGO organizes the government,the business and the public to mediate contradictions through the round table and other forms.ENGO has been recognized by academia and the law in the specific legal relationship in the subject position.However,with the appearance of the shell ENGO,the social credibility of ENGO is gradually decreasing.Then,how can we effectively deal with the dual crisis of ENGO,is related to the survival and development of ENGO.This paper discusses the legal regulation of China's participation in environmental protection from the respect of improving the existing ENGO's participation in environmental protection.Through the use of the rule of law,combining the experience with the United States,Germany,India,Japan and other countries and the reality of China's development,to put forward feasible recommendations,so as to promote the ENGO in the rule of law within the track to run,grow and develop.
