China's Environmental Ngo Participation In Environmental Affairs Legal Issues

In recent years, the environmental NGOs in China have gradually become active main bodies in the field of environmental protection, and their development is very rapid. Faced with serious environmental situation in China, they actively carry out activities of environmental protection and provide environmental services in order to protect the environmental quality and public interests, and promote harmony between human and nature, and thus strengthen their position in the process of sustainable development. However, their participation in environmental affairs has encountered many legal difficulties, adverse to their healthy development and effective participation in environmental affairs. This paper has based on the "new trends and problems co-exist" situations of participation in environmental affairs of the environmental NGOs in China, and analyzed the legal difficulties which they encountered in the process of participation in environmental affairs, to provide legal responses to protect the full and effective participation in environmental affairs of the environmental NGOs in China. This article has five parts:The first part discusses the meaning of the environmental NGOs, the historical conditions of the rising of environmental NGOs in China, the theoretical basis of the existence and development of environmental NGOs.The second part introduces the "new trends and problems co-exist" situations of participation in environmental affairs of the environmental NGOs in China.The third part analysis the legal difficulties in accessing the legal dominant status, funding, protecting rights of the environmental NGOs in China and effective supervision, which the environmental NGOs in China encountered in the process of participation in environmental affairs.The fourth part investigates the legislations of some foreign countries, such as the United States, Britain, Germany and Russia, in order to improve the legislation in China.The fifth part provides legal responses to protect the full and effective participation in environmental affairs of the environmental NGOs in China, including ensuring the environmental NGOs in China to easily access the legal dominant status, funding, protecting rights of the environmental NGOs in China and improving the system of multi-sound supervision.
