Study On Eco-Tourism Resources Protection Legal System In China

"Eco-tourism" has gradually stepped into people's sight since the eighties of last century. China is a country with abundant resources,and the eco-tourism resources are very rich, but Chinese eco-tourism is still in the initial period of development, and the eco-tourism resources protection legal system is not yet mature, too. The legal system construction is imperfect; the planning and development of the subject is not clear; the eco-tourism certification system has not yet been established; resource rotation is not yet implemented system; eco-compensation is lack of effectiveness; regulatory efficiency is low and so on. These problems lead to the destruction of the eco-tourism resources in the process of development and utilization. So how to effectively protect the eco-tourism resources at the same time in the development of eco-tourism is the focus of our future work.This paper briefly introduces the definition, characteristics and classification of eco-tourism resources, and points out the existing problems of our country's eco-tourism resources protection legal system. Refers the advanced experience of foreign countries such as the United States, Australia and Japan, and puts forward concrete and feasible suggestions on perfecting legal system of Chinese eco-tourism resources protection, expecting to promote the healthy development of Chinese eco-tourism resources protection. Strengthen the legislation construction of the eco-tourism resources protection in our country; improve the legislative level; strengthen the system of legal norms of construction. Improve the eco-tourism resources development planning system; establish a clear planning body; safeguard the unity, scientific planning, and take various measures to promote community residents to participate effectively in the resource investigation and evaluation process. Construction of the eco-tourism certification system in China, led by the government certification office to carry out the relevant certification work; scientific certification standards. Accelerate the eco-tourism resources rotation system construction, and incorporate into the legal track as soon as possible; increase promotional efforts and improve the ecological. Expand the eco-tourism resources compensation scope; compensation for diversification; guarantee effectiveness of eco-compensation. Consummate the regional tourism resources supervision system; establish the regional regulatory mechanism structure; centralize the supervision authority to prevent the policies, and adopt franchising way to realize the separation of government and enterprise; clear regulatory responsibilities of the position; improve the effectiveness of supervision.
