The Research Of Medical Assistance Legal System In China

At present, China is at the stage of the acceleration of social transition. This is the process of resource redistribution among different groups. Because the adaptive capacity to economic environment of people is different, there is a large gap of the fortune they create and gain. Then there comes the polarization of wealth. Where there is a gap, there is something or somebody working on shortening it. Medical assistance is the system that can shorten the gap between wealth and poor. As the last protective screen of social security system, it not only helps people to meet basic needs, but also improves itself continually. Social assistance makes people survive, on the basis of that what people chase is health. Medical assistance is one of the most important systems in social assistance system to guarantee people realize their health right and maintain fair in the field of health. Furthering study the medical system in China has important significance to promote the legislation of medical assistance, complete social assistance system and maintain social stability.The article mainly discusses and analysis medical assistance legal system at home and abroad, finding the shortcomings of the legal system at home. On the base of reference of overseas successful experience, the advices of completing medical assistance legal system were studied in the paper. The whole article is divided into two parts. Part one is a preface, it summarizes the current situation of medical assistance system at home and abroad, the problem that to be solved and the theoretical significance and application value of the study. Part two is the body part, which is divided into four chapters. Firstly, the body part states the basic theory of medical assistance, such as concept, legal character, theoretical basis and so on. Secondly, it studies several foreign countries medical assistance system, which have more reference value to our country. Through the comprehensive assessment of the system in these countries, we can find some better ideas for our system design. For instance, we get some valuable information for the legislation activities, the right time to get involved in the courses of treatment, ways to coordinate with basic insurance.As can be seen from the report of the eighteenth CPC National Congress, what we are going to build is an urban-rural integration social security system. As one of the most important parts of social security system, it will fulfill urban-rural integration sooner or later. From the law which is published recently, we can tell the attitude our government hold about urban-rural integration of medical assistance system. The unique view of this article is that writer put urban and rural together to research, not separate them from each other.
