With the continuous advancement of socialist market economy and rapid development of industrialization and urbanization, China’demand for land is continuous on the rise, especially the demand for land for "non-public interests". However, the current land system of China separates the urban state-owned land and rural collective construction land, developed into a dual structure of urban and rural land market. To break the dual structure of land market and to provide institutional guarantee for demand for land for "non-public interests" have been the new problems of reformation of land system.Report to the 18th National Congress of CPC clearly pointed out that to establish the unified construction land market of urban and rural gives direction to reformation of land system. This paper, through analyzing the current problems of the land system and researching on the current reformation of land system and establishment of the unified construction land market of urban and rural, attempts to get that reformation of the current land system can meet the demand for land of "public interests", but it is unable to meet the demand for land of "non-public interests" and it is even difficult to break the dual structure of land market. Then it proves the necessity and feasibility of the unified construction land market of urban and rural from the perspectives of theoretical basis, policy basis, thoughts basis, practical basis and so on. What’s more, it further analyzes the problems of decrease of cultivated land out of interests, impact that rural collective construction land accessing to the land market poses on the urban land market, farmers’ boycotting and relying on the income of collective construction land transfer that can be existing after the establishment of the unified construction land market of urban and rural. Finally, it draws a conclusion that it is necessary to separate the land for "public interests" and "non-public interests" when establishing the unified construction land market of urban and rural. As for land for "public interests", since the particularity of land resources and failure of market mechanism can assure the government of certain administrative authority, the land demand can be achieved by land expropriation, but the scope of land requisition is strictly limited in the land for "public interests". As for land for "non-public interests", there will be market mechanism introduced to well perform the role of market allocation of land resources optimization.To establish the unified construction land market of urban and rural is the outcome from cooperation of a series of systems. This paper, through land property right system, land requisition system, relative reforms of market, guarantees the reasonableness, health, orderliness, and sustainable development of the unified construction land market of urban and rural. Finally it can achieve accessible regulations of land for "public interests" and "non-public interests", making the rural collective construction land and urban state-owned land integrate into the whole and really realizing identical land with identical price and rights.
