Since the reform and opening policy, with the establishment of socialist market economy,China’s state-owned land market has been fully developed and improved, while the ruralcollective owned land market institution reform has rarely changed a little. It resulted in theobvious urban-rural dual structure of construction land market, which impedes the fast, fair,efficient transfer of land resources. Therefore the third plenum of the17th communist party ofChina central committee put forward clearly for the first time to establish a unified urban andrural construction market, carried out several pilot workplaces. And the third plenum of the18th communist party of China central committee further showed the determination of theestablishment of a unified urban and rural construction market and arranged more details ofthe pilot work. The current researches focus on the single aspects, such as land expropriationsystem, collective owned land circulation, measures of the establishment of the unified urbanand rural construction land market and so on, and do not put forward thesystematical.institute.This thesis, based on the institution change theory, land rent theory, property rightstheory, macroeconomic regulation and control theory, applies literature analysis, summarizingmethod and system analysis method to systematically research the institution of establishingunified urban and rural construction market of China. This research considers the dualstructure is the profound character of rural-urban construction market. There are four instituteobstacles of establishing unified urban and rural construction market, including imperfect landlaws and regulations, imperfect rural-urban land property right, unfair distribution of landvalued-added income and the imperfect function of government. Taking the improvement ofland expropriation system and rural collective construction land transform transacted inmarket directly as breakthrough, the institute, in which urban and rural construction land havethe same rights and government only inspects and controls the market, can be establishedfrom three directions, including expanding rights, reform land expropriation system, andsystematical supporting measures. The systematical supporting measures include perfecting land laws and regulation, rural land property system, tax system, transaction platform, andtransferring government function.This thesis researching on the institution of establishing unified urban and ruralconstruction market follows the direction of land reform in China, and it has importantguiding significance and application value to solve the problems resulted by the dual structureof rural and urban construction land.
