In recent years, the haze weather occurred frequently in China. Haze is not only harmful to the human body, but also restricts the economic development. In order to improve the air quality, the government has taken various measures, such as adjusting the energy industry structure, promoting the new energy actively, shutting down a number of enterprises with high pollution and high energy consumption, limiting the motor vehicle and eliminating the yellow sticker vehicles. These measures eased the pressure on the haze to some degree. However, due to the inherent mobility and instability of the atmosphere, haze always spread and infiltrate in different administrative areas. The mobility of the haze makes us realize that if we only rely on the local government and enterprises to governance haze pollution, we cannot be successful efficiently. We must seek the cooperation of the governments and the environmental protection authorities in different provinces.During the procedure of dealing with the haze, precedents for preventing and controlling have existed, such as the scientific and effective methods appeared in Olympic Games and the World Expo. The atmospheric pollution controlling method in key areas has been regarded as a new chapter in "Prevention of Air Pollution". Although pollution joint prevention and control against haze has been involved in legislation and actual practice, still many issues exist. This article mainly analyzes the shortcomings of the system coordination, the ambiguity of the management and problems occurred during area law enforcement.This article contains four parts. The first part is the theoretical research of the Chinese legal system of interstate joint haze prevention. In this part, the author mainly analyzed the reasons of establishing the legal system of interstate joint haze prevention and the possibility of the legal system of interstate joint haze prevention and governance can be established in China. The second part is the empirical analysis of the legal system of interstate joint haze prevention of China. In this part, the author firstly introduced the current the legal system of interstate joint haze prevention in China from the legal and the practice, and then summarized the problems existing in the legal system of interstate joint haze prevention. The third part is the introduction of the foreign experience of pollution joint prevention and control. In this part, through displaying the experiences of the United States, Japan and Canada on the control of air pollution, summarized the mechanism construction of the legal system of interstate joint haze in our country. The fourth part is the improvement for our country’s legal system of interstate joint haze prevention. The recommendations mainly include four aspects, coordinating the legislation of the legal system of interstate jo int haze prevention, straightening out the management system of the legal system of interstate joint haze prevention, constructing the monitoring and sharing system of regional air quality information, strengthening the linkage law enforcement.The author hope that through analyzing the problems of the legal system of interstate joint haze prevention of China and learn from the desirable part of the foreign legal system of interstate joint air pollution prevention, some suggestions can be proposed to promote the work of the haze governance in China.
