Study On Strengthening Countermeasures Of Local Government Responsibility When Preventing Air Pollution

With the mass outbreak of “fog and haze” recently, the issue of environment,especially the issue of air pollution, has been the focus of everybody in the society. The government whose behavior is going to be seen by all the public, actually is the represent of public rights. In addition, “The Eighteenth Member Congress of CPC” said, “the construction of ecological civilization is something that relates to people’s good fortune and the nation’s future”, which led a road of translating government functions in the totally new period. Constructing a better environment responsibility system and promoting the performance of government’s responsibility, are important ways of translating government functions, advancing the governance ability and elevating the government’s credibility. Currently, what is the meaning and intension of government environmental responsibility? What are the problems and their reasons of local government’s protecting air pollution. When confronting all the successful experience of protecting air pollution at home and abroad, how to choose the ways that can be promoted in China widely and how to structure a government responsibility system, are directly related to the effective of protecting air pollution.Government environmental responsibility, one aspect of government responsibility, which is also called government ecological responsibility, is the government’s obligation in protecting environment and legal consequence in violating the obligation, which is ruled by the law. As air pollution is becoming more and more serious, people’s voice on preventing the air pollution is growing louder and louder, and environmental governance globalization is increasingly clear, the government must pay more and more attention on strengthening the government responsibility in the prevention and control of air pollution. Firstly, with the basic theory of air pollution preventing and the government responsibility, this paper studied the basic concept, theoretical basis and the specific content of governmental responsibility in preventing air pollution. Secondly, based on the problems and reasons in the local government’s behavior when preventing and controlling air pollution, the paper introduced the experience and enlightenment of domestic and international air pollution prevention and control, and explored the solutions and strategies of strengthening the government responsibility which were focused on the legal system, information disclosure system, multi centre mode and performance evaluation mechanism. Thirdly, the paper pointed out the problems when the local government is preventing and controlling air pollution from the following four aspects: the imperfect legal system, the opaque information disclosure, the single preventing subject, and the intergovernmental cooperation obstacle. At the same time,the paper took this as the clue and found out the causes of these problems. Lastly, in the summary of domestic and international air pollution prevention and control experience, the paper mainly introspected from the following aspects :perfecting the legislation, innovating science and technology, information disclosure and the regional cooperation. Thus, the paper put forward the countermeasures to strengthen the responsibility of local governments in the prevention and control of air pollution: establishing the prevention and control of air pollution legal system, setting comprehensive air information disclosure system, innovating a multi-center air pollution preventing and controlling mode, and adding a reasonable government performance examination of preventing and controlling.
