In recent years, the role of network public opinion is increasing significantly, even affect the behavior of the NPC's legislative and public policy. Relying on strong pressure of public opinion, more and more leaders begin to focus on the topic. Network public opinion has become an important form of supervision and play a special oversight functions. Through exercising the network supervision right of public opinion, on the one hand, citizens can monitor the government actions of exercising public power, on the other hand, it can also protect the citizens fundamental rights enshrined in the constitution, thereby to achieve social equity and justice. But, in fact, due to absence of appropriate mechanisms and legal norms about network supervision right of public opinion. The role of network public opinion has not been fully exploited. Due to lacking of clear regulation limits for network supervision right of public opinion, When citizens exercise network supervision, other legitimate rights and interests are frequently injured.In the introduction of this paper, we give a brief overview about the status of network supervision right. In the first part of the paper, the concept and the nature and the theoretical basis about network supervision right of public opinion are elaborated. In The second part of the paper, through the analysis of relationship between civil rights and freedom of speech, boundaries about network supervision right of public opinion are defined. In the third part of the paper, we analyze the reason about constraints of network supervision right of public opinion in real life - including the conflict against private rights of civil and jurisdiction. In the fourth part of the paper, we propose the legal remedies on the present situation about network supervision right of public opinion: first, establish and improve laws and regulations of the network public opinion; second, enrich and improve the system of open government information; third, propose specific measures about the conflict between network supervision right of public opinion and private rights of civil and the judicial power.
