| Under the great pressure of the environmental pollution and energy crisis, more and more countries are beginning to focus on the development and utilization of renewable energy. Solar photovoltaic utilization is canonized by many countries and regions because of its character of environmental friendly, renewable, and large reserves. However, as a new field, solar photovoltaic utilization is facing many negative factors, such as high costs, unstable market, and changing development environment. To this end, the United States, Germany, Japan and some other countries have established a variety of legal security system to promote the smooth development of solar photovoltaic utilization. China is no exception. However, because the development time is too short, many legal security systems are still not perfect enough to promote the development of solar photovoltaic utilization. Therefore, to improve our legal security system under the new conditions is very important for enhancing its market competitiveness and promoting the popularization and application.Based on the background analysis of international and domestic energy and environment, this paper introduces the advantages and development opportunity that the solar photovoltaic utilization has under the double pressure of energy crisis and environmental crisis. Through the analysis of the existing laws and regulations, and the legal security system of solar photovoltaic field, this paper summed up the problems that our country has now:low legal level; lack of unified planning, tax incentives, strong financial subsidies and perfect financing mechanism. Then, based on the reference of the advanced system of United States, Germany and Japanese, this paper made a number of recommendations to improve our country's legislation and the legal system. These include:improving the strategic position of the solar photovoltaic utilization; making the long-term development plan scientifically; improving the legislation, incentive system, financial system, quota system and generation price system. |
