| Energy is the lifeblood of national economy and the material basis of human survival and development.Mankind’s exploitation and utilization of fossil energy not only lead to the depletion of fossil energy,but also cause irreversible damage to the earth’s atmosphere.In response to the global situation of fossil energy depletion and deteriorating atmospheric environment,China has proposed a "two-carbon"goal,which means that China aims to achieve carbon neutrality by 2060 and strive to peak carbon dioxide emissions by 2030.In order to realize the "dual carbon"vision,our country launches "whole county promotion" policy in the field of renewable energy,and vigorously develops distributed photovoltaic,taking "whole county promotion" pilot development as the policy to upgrade the consumption of energy structure.However,in the process of implementing the "whole county promotion" policy,due to the unclear understanding of the national strategic objectives,the phenomenon of "movement" carbon reduction appears in practice.In the promulgation of policies,there is a "one-size-fits-all" implementation,which does not take into account the differences in local resources;The effect of supervision shows the situation of "one enterprise package one county",there are possible problems such as violating the law of market development.The "whole county promotion" policy is a measure to achieve the "double carbon" goal in the energy field.A series of problems in the implementation have exposed the lack of government supervision in the field of photovoltaic power generation.At present,most Chinese scholars carry out research on government regulation of photovoltaic power generation from the perspective of public management and administrative law,and pay more attention to the description of regulatory behaviors such as power generation,grid connection,price and other links.There are differences in research perspectives and emphases.Few scholars have studied the government regulation of photovoltaic power generation from the five aspects involved in the definition of government regulation,and these five aspects,namely regulatory objectives,subject,basis,behavior and effect,cover the whole process of government regulation,making it more comprehensive in perspective.Starting with the status quo of the government supervision system of photovoltaic power generation,taking the problems highlighted in the implementation process of the"county promotion"policy as the sample,summarizes the problems in the practice of government supervision of photovoltaic power generation;And through sorting out the regulatory system of renewable energy in developed countries outside the region,learn from their experience and enlightenment.Based on the basic theory of government regulation from the perspective of economic law,this paper studies the logic of regulation target,subject,basis,behavior and effect.At the target level,the concept of "sandbox regulation" is proposed to combine with the government regulation of photovoltaic power generation,and the government regulation of photovoltaic power generation is incorporated into the national development strategy and the new energy development strategy,and the orderly progress is made.At the behavioral level,it is suggested to introduce a special regulatory law on renewable energy,coordinate the development strategy of new energy and the policy of photovoltaic power generation.In terms of effect,it is suggested to strengthen the dominant position of the market,make good use of "visible hand and invisible hand",and explore diversified market development mode to promote the steady development of photovoltaic power generation. |
