Energy is the material foundation of human civilization,and a strong backing for the national economy and people’s livelihood and social progress.The uncontrolled exploitation and utilization of fossil energy by human beings has caused irreversible damage to the atmospheric environment on the one hand,on the other hand,there are few traditional energy stored on the earth.Therefore,human beings must find alternative energy sources.In this situation,renewable energy came into being.Solar energy is one of many renewable energy sources.China has abundant solar energy resources and has unique development advantages.Solar photovoltaic power generation technology is an important way of solar energy utilization,its technology development is mature,and the industry is also quite developed.However,solar energy faces many obstacles and difficulties in the process of converting into photovoltaic products.The development of photovoltaic power generation technology in China is late than that of foreign countries.In order to catch up with it,it is obviously not enough to rely on policy guidance.It is necessary to promote,guarantee and regulate it by using legal norms from the legal level.At present,the legal protection of photovoltaic power generation in China is dominated by the renewable energy law.However,there are still many imperfections in the content of the law.The relevant laws and regulations,such as the total target system,the electricity price system,the economic incentive system and the supervision system,are not mature enough to meet the demand of the stable and orderly development of the photovoltaic power generation industry.In the new economic situation,we need to improve the legal guarantee mechanism of photovoltaic power generation in China,and integrate the whole process of photovoltaic industry chain into the adjustment scope of legal system,and promote its healthy and sustainable development.The problems encountered in the process of industrial development are caused by many reasons.This paper first introduces the achievements,changes in scale,market scope,potential and unique characteristics of photovoltaic power industry in recent years.Then,it expounds the problems and reasons restricting the development of photovoltaic power industry in China.Then,from the legal system level,the relevant laws and regulations are combed,This paper analyzes the problems of the legal protection of photovoltaic power industry in China from the aspects of legal system and system.On the whole,the legal rank is too low,the authority is lack,the lack of foresight of legal formulation can not meet the needs of industrial development,the lack of basis for policy implementation and the corresponding regulatory system and mechanism are not perfect;From the specific system,the target total amount system,the electricity price system and the economic incentive system all have the problems to be solved.Finally,according to the actual situation of our country,the paper puts forward the suggestions for improving the legal protection which is most suitable for the development of photovoltaic power industry in China,attaches importance to the allocation of resources by the market,repositions the role of the government in the market,constructs a system system which is compatible with market regulation and government guidance,and establishes a complete photovoltaic industry supervision system mechanism,We should pay attention to the implementation of relevant legal systems and policies,improve the enforcement of power and the effectiveness of law enforcement,and build a legal guarantee system conducive to the development of photovoltaic power generation industry in China.
